Do i still need to take the NLE even if i already have a greencard? before NCLEX?

Hi, i am actually new here. good thing i was browsing the internet, i never really thought that a lot of people are giving help in answering questions regarding stuffs like these.

Anyway i am Filipino, greencard holder/US immigrant - CA. i just went home here in the Philippines to pursue my college(nursing degree). I am really bothered if i am going to take NLE - Nursing Licensure Exam before taking the NCLEX-RN?

---->> I actually have read the requirements in the internet regarding international students, a letter of explanation is asked if an applicant doesn't have any license. Can anybody as well tell me how do this thing work?

You do not need to take local boards, you just summit letter with application. The problem arises if you take it and fail. Plenty has been written so suggest a good read. Hopefully you maintained your green card status

We are hearing that CA is changing their requirements to requiring the NLE before they will let someone meet their requirements for licensure. Since you are still a passport holder from PI, you will need to meet any requirements for the local license there in most cases. Having a green card does not waive that requirement for you, as you hold only permanent residency status here and still have a passport from your country.

You are unable to submit your application for licensure until you have a completed set of transcripts and then expect a wait of four months or so to get approval to sit for the NCLEX exam. Even though you are a greencard holder and even have a SSN#, the issue is that you trained out of the US so always will be considere a foreign grad where ever you wish to get licensed in the US.

Licensure and immigration are two very different things and are treated as such.

Suggest that you check directly with the CA BRN at this point in time, they are the ones that are going to make the final determination for you about the NLE. And please get it in writing from them.

With regards in submitting a letter of explanation i haven't really taken the NLE yet since i haven't graduated, am still on going with school and a 4th year college student. The thing is there is this memo written by PRC (the one's giving the NLE) that for us March 2008 BSN graduates we would be talking the exam on NOV 29 and 30 2008, which should be JUNE 2008!! I just thought it would be waste of time if I am going to wait that long just for me to take the NLE. I did maintain my green card status though. Thanks again for the reply.

Thanks for giving me an idea with regards to my concern. If ever you have read what i said earlier, that is really my main reason why i was asking if it would be fine if i wouldn't take NLE anymore(cause i also read some of your posts and answers and you said "The law states that the nurse must pass either CGFNS exam or the NCLEX-RN exam. No where does it state anything about a local license as a requirement.")-- i'm a bit confused already. Besides that, I just thought I wouldn't be working here in the Philippines since i am already a resident of CA. I am really bothered on what to do. Anyway thanks. Hopefully you would still communicate with me.

CA is in the process of changing their requirements, this is what we have been hearing. That is why we are telling you to check directly with the BRN at this time. I did read what you had posted and things are always changing.

The issue that you have a green card has no bearing on this, you still are a legal citizen of the Philippines and if it becomes a requirement that the NLE is required before they will let you test, then you are behind that requirement. Licensure and immigration are two very different items and are not related. You graduated overseas, so that makes you a foreign grad and subject to those requirements. Even if you hold a US passport, you are still treated as a foreign grad, but if a US citizen, then you would not qualify for the NLE exam so that requirement would be waived for you.

The new requirements that we have been hearing about were supposed to go into effect last week, but we have also had bad storms in northern CA so things have been delayed. This is supposed to go into effect for any that are applying after the first of this year.

Licensure requirements are always changing, and we are expecting it to go back to requiring the local license for most states; just as it was previously when the CGFNS exam was a requirement for all. That required the local license before one could sit for that exam.

And I will still answer your questions. We just want you to make sure to check directly with the BRN, they are the ones that make the final decision.

Legal residency does not remove any of the requirements for you for licensure in the US. Does not affect that.
