What is the role of dept of health in relations with hipaa violation occurred in the hospital. What penalty do they impose to the nurse involved?if the nurse is not at fault? Do they still get penalty??

The Dept of Health committed a HIPAA violation about a patient in the hospital? And the patient's nurse was involved, and will "they", ???? the Dept of Health, or the patients nurse ???, get a penalty?

And what penalty do "they" impose to the nurse involved....."they" the Dept of Health ??? or "they" the state Board of Nursing...or "they" the hospital?????

The United States Department of Health and Human Services...Office for Civil Rights investigates HIPAA violations. State Attorney Generals can assist and take action against HIPAA violations.

Sorry for the misunderstanding. A colleague of mind got suspended at work a year ago because of hipaa violation.it was a 1 week suspension. Now she was notified by her manager that cdph will interview her in regards with hipaa violation that occured a year ago.if the nurse already got suspended, does she get penalized by the dept of health???

The DOH is 100% separate from the employer. Yes, each body can determine disciplinary steps under their jurisdiction. The department of health and human services (which I assume is what you're referring to as opposed to a specific state DOH) is the primary enforcer and has the ability to levy fines and civil penalties as well as criminal charges.

Sorry about your friend. A year ago it happened, she was suspended, now The Dept of Health wants to interview her?

Felt sorry for my colleague.the way she told me the situation, left the computer unattended to attend a patients need ( maybe there was a call light or a bed alarm triggered). Someone used her computer to check a patient
