Deleting or changing shifts requirements

Hello,

I know the hospital has the right to change a shift or delete a shift but I also believe that the Nursing department is required to submit a request to NYSNA 60 days prior to changing anything. I want to ask anyone if this is right or did I missed anything. Thank you for the input.

The nurse was cleared, came back within her 6 months. NYSNA rep told her to get cleared, HR confirmed, she will get back the 12 h if she gets cleared on a particular date. The nurse got cleared on an earlier date before the deadline. After the nurse did all of that with their assurance, HR and NYSNA rep, said, the nurse lost her previous shift. The nurse worked there for more than 20 years.

Did HR confirm in writing that the nurse would be guaranteed the 12 hour shift if she was cleared within the 6 month time frame?

Would the NYSNA even have any standing on this issue? Unless OP is confused between the state nursing association and the state Board of Nursing.

The State Board of Nursing would have no concern about what shifts an employee is offered upon return after 6 months of disability either.

OP, employers are only required to save a position for 12 weeks when an employee is out on FMLA. Even then, they are not required to offer identical shifts when the employee returns, just an "equivalent position." This employee has a job to return to after 6 months out on leave. Most employees would not.

Are you the nurse? I am sorry it turned out that way. Crap happens. I took a per diem job at a particular agency because there was no call. Less than 3 months after I started, they put per diems on call with no compensation like the fulltime staff. Stinks.
