I'll try to make a long story short here; felony 5 possession of drugs that were found in my vehicle during a traffic stop, were found among possessions in my vehicle that did not belong to me. I was charged after becoming a nurse, board of Nursing suspended my license upon self-reporting when I attempted to renew. Could not afford a lawyer, board offered a Consent agreement, I signed because the stipulations seemed reasonable. I am awaiting my agreement to be ratified next week. My two main requirements to reinstate are; 1) a drug/alcohol course once a week for three consecutive months prior, and 2) random drug screening for 60 consecutive days prior to reinstatement. I have been attending a 2 hour class once a week since march, and I have been consistently drug tested since July at my request. My question is, does anyone know if the board will consider what I have already been doing? Or will I have to start all over? Thank you for any feedback! This is the Ohio BON.

Where you found guilty of any crime? Did the incident take place before or after becoming a nurse? Those requirements seen reasonable enough to me if I understand them right. I would hope you would be given "credit" for anything you have already completed as that makes sense to me but I'm not from Ohio and these programs seem to be abundantly full of no sense at all. I was charged but not convicted because I opted to take what they call Intervention in Lieu of Conviction, when I complete treatment through the court, my record will be completely sealed. It happened prior to my licensure as a nurse but I was not formally charged until after I received my license. I've just been doing everything possible to show that I am a good person and nurse. My DON is even holding my job for me until I am able to reinstate my license. I don't hear very good things about the OBN either í ½í¸§

FWIW, I was told by a lawyer that even though sealed, it will still be found (due to FBI fingerprinting). At least in the state I am trying to get my license re-issued. I also had a charge (no conviction, sealed). I chose to disclose to the BON, as I figured they would find out. I am awaiting the decision on if they will reissue. It can take up to a year in AZ.
I do identify as an alcoholic, and did follow all the recommendations of the court and finished their diversion program. I have been clean and sober 12.5 years now.

Just call them and ask. I hope it counts but usually these programs are really specific and you have to go to a certain lab and get specific drug tests done. Not all drug tests are the same. Some of our tests cost more than others and you never know which test you have to take. I know in IL we get two expensive tests a year and the rest are cheaper. So I have a feeling it won't count. I have heard Ohio is strict but I dont think it would count in any state unfortunately. Good luck!
