Compact Licenses

Unless you are a legal resident of the US, and actually living in a state covered by the Compact License Pact, when you apply for licensure, you will not be covered under this.

Which means that if you are out of the US when you apply for licensure in the US, you are not covered by this agreement among certain states.

You must have a legal residence in the US for it to be available to you, meaning that you have an apt or a home in a state and wish to keep that and work in a second state...........and pay taxes and either rent and/or mortgage for two different places. This is the only way that it will work.

It was designed for nurses that live in one state and want to work in another that may be very close by, or for travel nurses that wish to do assignments in different states but not have to go thru the licensing process each time.

If you are a foreign nurse, you will need to endorse to any other state that you wish to get a license in. And this is after you actually hold a license for a state in the US.

(Hope that this helps clear up any false impressions that you may have heard of or had.)

Dear Suzanne,

Thank you very much for the reply. I think I have to apply for the AZ license soon. The problem is that I haven't had worked within five years of the date of application in order to qualify for the AZ license. I might have to take a refresher course. The thing is that I don't know if I can take the practical part of the course with my H4 visa.

Thanks

You are aware that with H4 you can't work and unless your other half is already in the process for GC you are looking at a few years due to retrogression and no way to AOS?

At this point in time, it makes no sense to go for the AZ license as you are not going to be able to use it. Not an issue with the refresher program, but the issue is that you are not going to be able to work for quite some time and suspect that your spouse's H1-B will be expired before then as well.

Thank you Suzanne, Silverdragon102

Actually my husband is going to apply for the green card soon.We also have our H1B and H4 status for 3 more years. Do you think it is better to keep my Iowa license at this time?

Thanks

Your husband can apply but this will not give you permission to work and with retrogression you are looking at years as currently no AOS and depending on where you husband is from processing dates are 2001 or 2006

At this point in time, there is no way for your husband to adjust his status. Sure, the I-140 can be submitted, but the US government is not accepting the I-485 and that is what he would need to be able to have submitted for him.

Not sure why this was not done last summer when there was the open window, but since there were about 800,000 petitions that were sent in at that time, and only 140,000 total visas issued per year and the majority were from your country; you are looking at probably six to seven years or so, if not longer.

If asking for my opinion, would not even consider doing anything at this time as you cannot work with the H-4 visa and all you would be doing is throwing out money since licenses also need to be renewed.

At this time, there is no way that you are going to be able to work in the next few years. Just not going to happen. There are far too many ahead of you in-line at this time and the US only grants less than 10,000 visas to those from your country per year.

I wish that I could tell you differently, but things are not looking good for you to be able to work here at this time. And chances of your husband being able to submit for the I-485 in the next three years is also quite slim.

That is just how things are right now.

Best of luck to you. I would just keep your one license current, and not do anything else.

Dear Suzanne and Silverdragon102

Thank you very much for the all information. As you said I will keep only one license. I think that is the best option.

Thank you very much again.

madu.

You are quite welcome.
