Client Transport, & Home Health Aide

Published

If you work for a Home Health Agency don`t you have the right to refuse to transport a client in your own personnel vehicle? or would that be grounds for termination? They offer reimbursement for travel, but thats it. If you have an accident your on your own. If the Client gets hurt since your driving, & its your vehicle. It makes you legal liable for that person.

If a job supplied the vehicle it would be a different story. Do you think that its within ones right to refuse to use your personnel vehicle for clients errands, appointments, or romp through town? Agency says you can`t tell a client no. However, I feel the client or agency needs to provide a vehicle for transport of client.

The official mileage reimbursement used by the IRS is $0.55. Fifteen cents, as a number on its own, may not sound like a lot, however, it represents a 40% underpayment. Furthermore, even if reimbursement were to cover all vehicle expenses, it still does not reimburse you for your time spent on more frequent maintenance. As a former pizza delivery driver, I can assure you, there is no way to come out even, let alone ahead, unless you can transport three to four clients at the same time, in which case you'd be in the transport business.

As far as a waiver is concerned, I believe it's purpose is to protect the agency, not the employee. The client may waive any action, however, the driver's insurance company could argue the fact that the vehicle was used for puposes not covered in the policy.

Forgive the caps please, but this is important. Anyone that transport patent with Personel Insurance: YOU ARE LIABLE FOR YOUR OWN VEHICLE, & ANY VEHICLE YOU MAY HIT WHEN TRANSPORTING A PATENT. THIS INCLUDES OCCUPANTS OF THE OTHER CAR. Even if your patents signs a waver. Your insurance is VOID when transporting a patent if it is personel. Do your self a favor & get commericial. I was quoted a $31/month increase for 2 cars.
