Castlebranch Background

Published

Hi, I recently completed my castle branch background for nursing and a criminal record was found. I knew I had a record but usually when I apply for jobs, it doesn't affect me at all. I have even been working in a hospital. The case was dismissed with no conviction and no guilty plea but I know schools state that they require a negative or "clear" background check. Would a dismissed case count as a positive background and possibly get my acceptance revoked? For reference, I am in Texas and also in the process of getting record expunged but that takes forever.

If you don't mind....can you elaborate about this criminal conviction about?

Yes , and please don't judge but it's an assault charge-family assault. It was a domestic abuse case in which I called the police on my ex partner for hitting me I had all the bruises and everything but because I pulled the wheel of his car to try and escape I was hit with a charge. They painted me as a jealous girlfriend. They dismissed it once I showed proof of previous harassment and abuse but ultimately I still have the record.

Firstly, not misjudging you. Perhaps speak to the place that have the records. That could be a start?....and have them correct it forever?

Any word?

Yes actually!! I was so worried , but I got an outcome letter from the board saying I was good to do and my castlebranxh background was still approved, I guess since it was dismissed.

What happened to the record you are expunging? That didn't affect/come up on Castlebranch? I am in the process of seeing if Castlebranch accepts my final order for my expungement. The state police in NJ is super backed up and won't be processed in time for me to take my background test. But I do have the final order signed from the judge approving my expungement.

@NurseforJesus24 It will not be up to castle branch, but your Board of Nursing.  Castle branch is a middle man to set up FBI background check screening and they have no impact on what shows up on your record.

For my stuff, the board did look into my background, but I did not have to submit a declaratory order. I have 1 expunged (the board can't see) and 1 order of non disclosure (the board still had full access to all of the information for this charge). My order of non disclosure: I absolutely expected and was prepared to be put through the wringer for, but was not. I received my letter of clearance 2 weeks after they told me my file was going to review.

Another girl in my class had a theft from not even that long ago that she did not have expunged or an order of non disclosure, and the board approved her also. She and I are from the worst state in the country when it comes to the BON, so don't stress. It's going to be OK.

IF the board does contact you asking for information, consult with attorney that specifically handles BON cases so that they can tell you exactly what to say to the BON. Never, ever speak to the BON without representation under any circumstance.

Wow thank you so much for your response! It has definitely given me hope! So happy your BON cleared you!

Glad to hear. Unfortunately when police are called, sometimes the wrong party is arrested. I had that happen to me as well. Luckily  I sealed the record, and it was not an offense this is exclusionary. My advice to is to report any arrest or pleas regardless of the outcome.
