Is it legal in Texas to care for a 3 1/2 year old in my home as the parents are planning a trip to Washington for a funeral? I don't mind as I have been her nurse for 3 years but what concerns me is the legality. What would I need to do to allow this to happen?

Is it private pay or through an agency? If it's through an agency I'm positive there is a company rule against that. If not a specific Medicare/Medicaid rule about providing services in the "clients home" If it's privet pay the question really becomes what's the difference between having the client come to your home and you running an unlicensed care facility? Additionally what would you're homeowners insurance say about this. The second you get paid for that kid being in your house you're running a business on their residential insurance policy.
It's a lot to consider and frankly I would rather avoid it if at all possible.

BON question there. Is it advisable even if it turns out not to be illegal? Whole lotta boundaries being crossed there. You're her nurse, not her legal guardian; even if temporary guardianship could be established, there's the issue of can you be paid to nurse someone in your guardianship care?

The parents need to secure actual childcare for THEIR child. You can then work your nursing shifts with the child as per your routine.
There is no way in hades I would take on the liability of keeping this child in MY home.

Legal or not I would never do this in a million years. Too many things that can, and probably will, go wrong. Save yourself!
