Can I apply in another state if denied or while waiting for a hearing with BON

Am I allowed to apply say for a NY nurses license, if i was denied in DE or PA? Just wondering? I was denied but now waiting on the hearing to take place, must you get a license in the state that you reside in first or does it matter?

For your purposes "state" shopping will no good. All fifty state BONs ask the same questions more or less about criminal convictions, and require background checks that will include state and federal records. If you have ever been fingerprinted your name will will show up in the federal data base. This will show if either the BON or other enitity does a fingerprint background check themselves or requests you obtain a "certificate of good conduct".

Most every state nurse practice act also have "moral" clauses preventing persons convicted of certain crimes from holding a license and or otherwise deemed unfit to practice.

Maybe ten or twenty years ago one could have gotten away with something like that, but everything is done by computers now, including fingerprint/criminal background checks.

Your problem is a particular state's BON, but the conviction. Will will vary by state is whatever laws are on the books regarding hiring persons with a criminal background and or refusing to issue a professional license. The two are not always the same.

Keep in mind also even if you are finally awarded a license by any state, hospitals and other healthcare settings will do their own background checks. If they find something they do not like, you won't be hired

Forgot to mention that the main reason your scheme wouldn't work is most if not all applications will ask if you have ever been refused a license and or had one revoked. If you answer "yes" you can be sure you will be right back where you are now. The other answer is not an alternative.
