Can a HHA be in charge in home care?

I work for a lady that is wealthy and bought out an agency contract to hire us, there is myself a nurse and another nurse and 3 home health aides. One of the home health aides is in charge, Is this legal? and must I take direction from an aide? this seems all wrong to me but when I bring it up to the lady she just laughs at me.This aide writes policies and procedures and she doesnt even have nursing experience!! any thoughts?:banghead:

no i did not and I didnt know this was the case when I was hired. I never worked for the agency.I have been a nurse for many years but home care is new to me

When you don't have the agency as your employer, you have no recourse with a client who has no respect for your interest in maintaining your license. The lady laughs at you because she sees you as no better than "household help", on the same level as the maid. Would you stand for the CNA supervising you in a facility? Of course not. Since you didn't work for the agency, my best advice is to get a job with an agency and get out of this dangerous situation. Think how you would sound on a witness stand during a trial, explaining to the jury how you were following the directions of the HHA. You wouldn't do well under those circumstances.

Hi : I was just passing by, and holy cow!!! What's this all about? I can't belive my eyes! I'm so sorry for you! But, anyway, I have no idea how you could do this, but my honest advice, is that you should immediately get out of this horrendous situation. You can't by no means work there, you should get a lawyer if you need. And that lady she knows nothing about nursing or HHA. God!
