Can CNA lose a certificate for pushing a mental patient?

Published

Hi, I have a following question:

My relative is a CNA in California. She works in a nursing home and takes care of mentally disabled residents. Recently, one of her patients (with dementia) slapped her, and she pushed the patient away. She did not report it because she thought that it is a minor incident. However, somebody anonymously informed the head of nurses that my relative hit the patient. The relative described the situation, and stressed on the fact that she has diabetes, and that during the accident she had hypoglycemia. Regardless of that, nursing home fired her, and they also send a report to the Health Organization saying that she hit back the patient (without any description), and didn't mention her own health condition. Can my relative lose the license and will she be able to find a job if not? Is there a way for her to defend herself (given the circumstances)? Would you recommend looking for a lawyer?

Thanks
