I applied for RN licensure by examination last 2013 and was deemed deficient for MedSurg, Obstetrics, and Psychiatric Nursing. Like any other IENs, I invested so much time and money looking for schools that would offer these subjects. After so much waiting, I got ahold of a school that would allow me to make up these subjects. I communicated it to my evaluator and got a confirmation that I would be issued a license after completion. However, I need to apply for Licensure by endorsement since I already passed NCLEX-RN for NY. During the process, I already started my application to the school since I already got a confirmation from my evaluator. Thereafter, I got a letter from my evaluator that I need to take the whole RN program for me to be considered for licensure. I thought this was just a miscommunication. I went to the BRN Sacramento from Los Angeles and brought my concerns personally to the BRN. I brought the deficiency letter I got last 2013, the new letter stating that I need to take the whole RN program, and copies of the conversation with my evaluator granting me to make up the courses. GUESS WHAT!? I had the pleasure of talking with my evaluator and 2 supervisors. THEY WERE SO RUDE AND VERY UNPROFESSIONAL. I dont wanna go in details anymore. They are $&@#%+!!!!!!
THE VERDICT: I WASN'T GRANTED TO MAKE UP THE DEFICIENCIES BECAUSE MY EDUCATION IN THE PHILIPPINES DOESN'T MEET THE CALIFORNIA's STANDARD.
I told them that I totally respect California's code and regulations for RN licensure.But, I don't understand why they've come up this adjudication. I am sooo comfused. How is my case different from other applicants who have the same curriculum and who graduated with the same school where I graduated??? Why were they allowed to make up the deficiencies? Why do I need to retake a whole RN program? I thought I was only deficient with MedSurg, Obstetrics, and Psychiatric Ng?
They cannot give me answers to those queries but threw me words of discrimination. They even told me that I don't have the prerogative to walk in to the office and talk to someone about my application. TOTALLY BS!! (

Number one mistake: you did not go thru the proper channels, you MUST file for an APPEAL via the appeals process and must be filed in writing WITHIN one year of your declination letter or you LOSE your rights to any further discussions. It should state that in your documentation or you can go to the CA BRN website.
Going in directly will do absolutely no good at all and do nothing but irritate the staffers there who are already short on employees. You're not the first to try this and it's not the proper format to make a complaint. What you've done is to skip this important process. You can try to apply for an appeal but if it's passed the one year deadline, you can expect to get a letter denying the appeals as those are the rules, no matter what country or state you're from, it applies to all applicants from local to international.
By going around the system and unless you can provide WRITTEN evidence of why you should not have to re-take the other deficiencies, they will simply tell you to go fly a kite. But you NEED to provide this written proof in the APPEALS process, where it's taken to a higher level than the supervisors. You will need to provide very good solid evidence of why and show case by case, date by date.
Remember the proof of the burden is not on the CA BRN, but on you and only you.
With regards to the taking of the entire RN courses and why some didn't and some do, it all depends on your transcripts as well as those other batchmates you refer to are they from the same graduation date/year? If you and the ones that just to take the deficiencies were from the exact cases and clinicals and literally jointed at the hips, then there are some concerns.
By saying and comparing yourself to others who did not have to re-take additional classes or re-do the entire program is not a good reason for why and what since it's all based on each individual transcripts and must be evaluated on its own merits.
We have heard (here) and I know of others personally who were from the same classes, same graduation year etc but it seems like the FAULT lies from guess where??

Can't be blaming the CA BRN evaluator if someone created the mix-up or was incompetent from the PH school. WE all know any PH staffer could care less as they feel you're going to make more money than them being in the States working at the local barista or big box retailer.
Remember also it depends on how your transcripts were submitted by the PH schools. I have heard of several cases whereby the staffers at the PH schools some are now "adjusting" (aka forging) transcripts to look good to the CA BRN, guess what? With the thousands of cases being seen by the CA BRN, they are now even more SUSPECT of all (as in every) transcripts coming in from any of the PH schools even the from the top 10 schools.
I'm positive that this form of cheating is coming from the top deans and if not from those below stemming from the heavy pressure placed on them from their own students, both past and present and from the angry parents.
Don't be blaming the CA BRN for trying to do their jobs, going in only makes your case more suspect. Honestly, I'm sure some are so desperate they may offer a "bribe" to the CA BRN. I say this only as I have heard from some friends who knew of this but failed as any staffers in a state job will not want to risk their job and face possible criminal charges and time in a cell.
I'm also sure that a staffer or two from the CA BRN reads these forums or if anyone else, probably an CA BRN investigator.
Don't forget to look into what really caused the CA BRN to look at the PH applicants, thanks to the CHED, PRC and PNA, who totally failed us PH grads and nurses in their lack of foresight even when told in the face from the CA BRN meetings (Dec. 2012 and prior years) to address the concurrency issues as well as insufficient minimum courses requirement as set forth by the CA BRN for the past 30 plus years.
CHED, PRC and PNA previously packing the schools up to the roof in order to the cash money cow and allowing more schools to open their doors and now today, doors are being closed due to lack of demand etc and mostly to not impact the better schools for the clinicals.
Then add in the other greedy and selfish PH grads and nurses who cheated their way into the CA BRN system by submitting false documentation causing the big ripple effect to all of the honest and hardworking students and nurses such as yourself and being placed in the same barrel of the rotten apples.
So to add on to my above comments, let's say you ask the PH school to re-submit the transcripts and now on the second attempt, you are in full compliance but it now makes the transcripts very more suspect and that's been the case recently and why it must be documented correctly the first time and only time upon the first submission to the CA BRN.
While it's probably easier for a PH school staffer to "adjust" (forge) a transcript if given the right amount of pesos, you know what I mean. I'm sure the CA BRN people know of this also.
I think what's happening if the transcripts are considered to be deficient in more than the usual 2-4 courses, from the eyes of the CA BRN, it will be easier to simply try to find a CA school to re-take versus trying to complete the deficient courses within the 3 year period to complete the application before it gets tossed into the "abandoned" pile. Taking the nursing program in CA that's approved by the CA BRN eliminates the issues of time frame to get it done which could almost be the same but maybe 1-2 years extra but now your transcripts will fly thru the CA BRN hands into the ATT approval.
To moki, you can try to contact the CA chapter of the Philippines Nursing Assoc., you will find that they, however, agree 100% with the CA BRN decisions but maybe you can find some assistance still.

I think you got me wrong steppybay. My concern here is they've already evaluated my credentials last 2013 and I was deemed deficient for MedSurg, Obstetrics, and Psychiatric Ng. I don't have any problems taking these deficiencies since I respect the code of regulations behind this issue. Last March 2015, I was contacted by this school offering these courses to comply the deficiencies. This school was referred to me from a friend of mine who completed the deficiencies and was issued a license by the CA BRN thereafter. He told me that they were about 50 IEN students completing their deficiencies at this school. I communicated this to my evaluator and granted me to make up the courses, however, I need to apply for Endorsement by licensure since I am already a RN in New York. She just told me to apply for endorsement and I don't need to resubmit the documents that was submitted by the school since they already have it on file. So I did what she said and started my application process for the school. 3 weeks after, I got a letter of denial stating that I need to take a RN program in order for me to be considered for licensure contrary to the first letter I got from last 2013 which stated that I need to take only 3 subjects. I don't understand what made my evaluator changed her mind and told me to retake the whole RN program. That is just ridiculous. I asked her why do I need to retake the whole RN program, wherein, I was only deficient with the 3 subjects?
And yes, the classmate who I was referring was from the same school, we graduated the same year, we have the same curriculum, and we almost have the same dates with our cases since we had a designated date for our completion of cases. He was granted to make up the deficiencies, but not retaking the whole RN program.
I also have a friend who was also offered to comply the deficiencies. He was also asked to reapply for endorsement since he's already a RN from another state and the evaluation is still the same from his previous. His evaluator was different from mine, though. Now, he is about to finish the program for completion of his deficiencies.
So that's it! ( I give up!
Anyway, thanks for the info steppybay! I've already read a lot of infos here in allnurses and also aware of the PNA/CHED agreeing with the CA BRN.
Hi Moki....thanks for the more clarification on your particular issues.
While each separate applicants and applications are to be reviewed on their own merits, there could also exist the differences in each evaluators eyes even if they are from the same schools.
I would still go thru the proper appeals process with the CA BRN as it seems like you're restarting the time line with the recent rejection but do so before the one year date of the letter.
Since you have personal knowledge of friend's names you may wish to include not only their names but also if they passed the NCLEX-RN and their names appear on the CA BRN website, you can document their name, license number and school they attended which should match up with yours.
Prepare the same cases and clinical dates to the best of your knowledge and make sure it matches line by line and date by date to your transcripts and why you also agree to the same previous 3 deficiencies and willing to re-take just those.
If you're able to document this, the proof of burden has now shifted to the CA BRN, as you will have hopefully presented written proof and now the CA BRN must take your information for further review of only having to re-take the 3 deficient courses and not the entire program.
Understand that providing the CA BRN with your friends names and their license numbers could or might re-open their own cases and transcripts to see if they were actually in full compliance and if so, it should not jeopardize their license.
The risk, however, might put their license even if granted already to be revoked and get a letter from the CA BRN made a mistake and can and have asked for the return of their license within 5 days or face adverse action.
There was a case reported here whereby it happened to an applicant from the Phils, got a CA nursing job and soon thereafter, got the CA BRN letter as they made a mistake in issuing the license. Since getting the license is a privilege and not a right, any license can be suspended, revoked or cancelled by them.
I would not give up yet, you still have one more breath left and use it to your advantage. Should the CA BRN appeals process, remain with their current decision at least you gave it a try rather than thinking "what if".

Thank you so much again steppybay. I think it's better for me to give up. I feel so hopeless anymore. I don't think I stand a chance of fighting this anymore since it is a state agency. It would also take so much time and money taking such actions. I've already spent 2 years waiting in vain, not to mention, the opportunities I've turned down. On top of that, I don't want to involve the names of my classmates who got their licenses after completing their deficiencies. Also, I already cancelled my registration at the school where I am about to complete those deficiencies which will start this coming May 23. That being said, there's no point of appealing this since it would take time for them to carry out such systematic review of my documents. I don't know if they have such thing but I am convinced that they are very incompetent and unprofessional in dealing transactions.
