Is it state law that you earn time and 1/2 after eight hours? I know several nurses in different counties who state this is true. No matter how many shifts in one week do you earn time and 1/2 from hours 8-12 on a twelve hour shift? Thanks.

not necessarily, depends on where you work. There's hospitals in my area that have nurses sign a contact to work 12 hour shifts with no time and a half. Anything after that is double time. I used to work at a place that paid straight time for 10 hours. So some of them do not.

Many workplaces in California that hire nurses will have them sign a contract that will prevent the employer from having to the pay time and a half after eight hours.
I worked at a Southern California factory (not as a nurse) for three years and was paid daily time and a half since I worked twelve hour shifts. Anything over 8 hours was overtime. This was from 2001 to 2004.

At one hospital they paid time and 1/2 after 8 hours. They paid a straight pay which was the 8 hours pay plus the 4 hours time & 1/2 divided by 12 hours. Example: $22 per hour for 8 hours=$176. $33 per hour (time & 1/2) for last 4 hours=$132. $176 + $132 divided by 12 hours =$25.67. So basically pay would be $25.67 an hour and any time over 12 hours was considered double time.
At another facility the base pay was $27.57 but they adjusted the rate to 14.29% of the base rate subtracted from base so the pay was $23.63 and overtime was time & 1/2. I don't get it either but it's just another way to cut corners when it comes to paying their nurses.

Most all nurse staffing agencies pay this way..On 12 hr shifts, after 8 hrs, pay is 1 1/2 not considered overtime on 12 hr shift.
If you are doing an 8 hr shift and stay over, then 1 1/2.
Hospitals tend to not pay you this way....no time and half after 8 hrs unless you are working 8 hr shifts, then you are paid overtiem at 1 1/2, If they are working 12 hr shifts then 1 1/2 after 12.
plenty of agencies to work for, more control over schedule, less company politics, better pay.

I was wondering the same thing while searching for RN positions in CA. Ask the facility if they have an alternative work week. Basically, you are asking when OT begins...after 40 hours or after 8. Some facilities said they lowered their hourly for accomodate the increase in pay for the last 4 hours and some facilities require a 12 hour day, so they won't pay the OT 8 hours.
