When I was 14 years old, I was charged with assault in the forth degree. Basically a kid was taunting and calling me derogatory homosexual terms and I punched him. A teacher saw it, I knocked him out with one punch and got arrested for assault in the fourth degree. It has now been almost 10 years since that happened but I'm not able to have it expunged. In Oregon assault in any degree is a "permanently reviewed" crime in which you have to have a fitness determination regardless of how long ago it was comitted. Is this something that is going to be likely to cause the OSBN to deny my license? I can get it expunged in a few months and Oregon law says that you are not subject to the fitness determination if it was from a sealed juvenile record. Should I just wait for it to be expunged before I apply to take my test?
Also, if they deny my license now can I reapply later after the crime is expunged and not be subjected to the fitness determination? Any assistance in this matter would be appreciated.

If you don't mind waiting the extra months I would wait for it to disappear off of your record. Only my opinion, I don't know how the law works, and I'm not sure if they will "always" know about your record if they do a background check before it is expunged. Good luck to you though :)
