Am I being discriminated at my job? Please HELP!!!!

Hello! I'm a new LVN who works in a psych facility, I have been working there for two years, the first year I worked there part time as a CNA while getting through the LVN program, after I got my LVN license in May I got hired as a on call LVN around July I was usually getting 64-72 hours per every two week pay-period, everything was going wonderful until I got moved to the A.M. shift recently, I work in a facility where 99.9% of the employees are Filipino and I started working the AM shift a few months ago,

I knew from back when I was a CNA that they had some kind of drama going on between all of them, and I also knew that they like to start rumors and get people in trouble specially people who don't like to socialize with them or are on the quite side, last month I notice that my schedule change from 72hrs to only 38 and when I went to speak with the DON she told me that the reason for me getting less hours is because my fellow CNA co-workers complained about me being mean when I don't even have time to talk to them unless is something work related, also I've noticed for a while that the new Filipino employees get more hours than me even when I have more seniority, also my fellow co-workers don't like to get reminded that they don't suppose to speak their language while their on the floor or providing patient care, so now I can't not even tell them that because they go straight to the DON and make stories up just to get back at me :no: I mean is this legal? can I get my hours cut for supposedly being mean without my employer doing an investigation? Please help any advice will be greatly appreciated.

Yes this is the same place, they started drastically reducing my hours starting in January, but like I mention in a previous post they were doing this even when I was working full time as a CNA, they reduce me to CNA part time and then to on call LVN, and today I found out they are actually going to fired me on the 4th, I'm not going to get another chance like the other employees who have done worst things than pre-signing the mars, just let me add that I have no other disciplinary actions in my file other than this 4 day suspension for pre-signing the mars

I find it strange that if they didn't like you as a CNA that they would offer you a position as an LVN. I tells me that this reduction in hours may be related to staffing issues more so than a punishment for you.

They 'are going to' fire you on the 4th? If you require terminating, you require terminating. They seem to be setting the stage for you to receive unemployment, since it makes no sense- and to let you KNOW, even, they 'are going to' fire you? Take notes, take names...

Meaning, how would they explain that you were fired 'for cause', when they tell you in advance? If they 'had cause', you would have been fired already. Not to mention the time that has already lasped since the incident happened?

Hello there yes they are going to terminate me on the 4th, after my 4 day suspension which is from April 1st-4th on the 4th I have a meeting with the DON but I talked to her this past Friday and I was made aware that they are planning on terminating my employment, so I pretty much know that they are just going to give me my check and send me out the door, and I strongly believe the reason they didn't fired me on the 26th is because they did not have anybody to cover my shift so they decided to put me on treatments until they had somebody to replace me, the new person started training the same day I was giving a suspension notice so now they have replacement for me so they are letting me go, and yes it was kind of weird how they took so long to suspend me since the incident happen on March 10th and I was giving a suspension notice on March 26th, they are not giving me another chance to learn from my mistakes and correct them, even know the DON said that what I did had not adverse effect on the patient care I provided the day so I'm aware that they are going to fired me Next week for sure.

This is not being fired 'for cause'. Start your unemployment claim, make it as detailed as possible. Be sure you mention that your hours were cut way back when, it shows a pattern on their part. And what type of manager would allow any employee, in and field, to continue to work after being informed he was going to be fired? The liabilty is outrageous.

Hello again there well she didn't even said I was a bad nurse, when I went in there to asked what they were planing on doing with me, she just told me straight up "well we are thinking about terminating your employment with us, but I can't give you a decision until the 4th when we meet" at that the time I was "well do you want me to just resign right now?" and the DON was "well like I said just wait until the 4th and I'll have a decision by then" I'm seriously living a night mare today was my last day of work with them, and I didn't even wanted to go to work because I feel soooo USED by this company, I already filed for unemployment but I know they are going to fight it so I might have to appeal it if they do and take it to court.

Are you part of a union ? If you are, you should definitely get them involved, if not it would be HR as someone earlier suggested.... Unfortunately as Others pointed out, they are within their rights when it comes to giving or lessening your hours since you are not considered permanent ( full time/ part time)... But that's not to say they have other "reasons" behind the scenes for doing what they are doing.. But if I read correctly, they already stated they were thinking of terminating you? I'm pretty sure if your terminated it happens on the spot. It sounds very unfair what is happening and they're may not be a whole lot you can do, and even if you could, why stay at a place that's treating you unfairly. My advice, do as much as possible to get HR involved and resign.

Another thought, try to take the option of resigning if it comes down to that. You don't want future employers asking why you were fired. Especially if its not truly warranted. Good luck

Hello suzie I wasn't allow to resign, as I stated last week I was informed I was going to be terminated on the 4th and I indeed was terminated yesterday, the DON informed that they are going to fight my unemployment so I don't know if I'm going to be able to win this, I feel so depressed and tired of this, I won't have no other source of income if I don't get unemployment and I don't think I will be finding a job any time soon so depressing :down:

I know it's easier than said, but don't get yourself down! Look at it this way, there is something better out there than this place of work! Pick yourself up, dust yourself off and be confident in knowing that you are fully equipped in finding a better job that knows your worth, and appreciates you!
