please read this closely:

1. the green card will not keep you from getting deported if you break the law in the us, something as simple as a dui can get you deported.

2. a visa out of status for any reason can get you deported. you get stopped for a traffic ticket, and out of status, do not pass go, and you will go to immigration detention.

3. a ssn# that is not a legal number will also get you deported. they are verifying them when you apply for a license.

4. does not matter if you have family, own a home, and a car, and even a business, if you get deported, you will be out of the country shortly, immigration does not care.

right now, ins is in a surge mode to pick up anyone that they find illegal in the us, for what ever reason..........please do not let this happen to you.

in california, they actually have immigration stops set up, and they are picking up people in large numbers. does not matter which country that you are from, how long that you have been in the us, etc. if you do not have a legal document permitting you to be in the us, you will be gone.

please be very careful. and all of the above also goes to nurses that have overstayed visas, immigration does not care. and if you get deported, it will be ten years before you will be able to return.

after consulting with multiple immigration attorneys, it is not expected that any special visas for nurses will be available until the congress and the house of representatives create new visas, and not until later in the year. there will not be any schedule a visas appearing in the januray bulletin of the uscis until they become available. right now, there is no preference....strictly on where you were born.. if your country does not use up its allotment, then you will be able to get a visa earlier, otherwise all will be waiting. no special cicumstances apply here.

Depending on how you get the EAD. If because

All EADs have a validity of one year or less. And those that can be renewed are done so just bvecause the requirements for the green card have not been completed. It is not something that is normally renewed and renewed and renewed.

I have a question: My EAD has expired and i filed a renewal for it couple of month ago. It is still pending. My AOS was filed February 06, I140 was approved couple of month later, but still no GC. Is it possible the immigration will not issue an additional EAD for me???

I'm an F1 student. I've graduated from an ADN program, passed my NCLEX (got a DC license) and after about 5 months of waiting (due to an error made in documents by my school) I got my OPT but for only 8 months! I used 2 months of my CPT, so I should have gotten 10 of OPT. But oh well, not only I missed an awesome internship at the hospital due to the wait for the OPT but now they don't want to re-hire me if I have only 8 months authorization to work. They sponsor for green cards but how long will that take? They are willing to do what they can but I don't know what to ask for. Should I apply for the green card now or after my OPT is over? I have a SSN#, I live in Maryland and got a job in Washington DC. Please advise.

Please refer to the threads that are already in place about the retrogression. There are no visas currently available now.

suzanne do the new laws that will be passed will any of those laws effect nurses or nursing students? i thought your post was very interesting and never realized there were so many changes. i thought you had to be a citizen or have a sponser to be a nurse or doctor here in the USA. i am sorry for my ignorace in this matter.

You must have an employer first. Without one, there is not one thing that an immigration attorney can do for you. The green card processing for the RN is employer driven, meaning that they have to petition you. The attorney just does the paperwork.

To attend school here as a foreigner, you just need to have a visa that will permit you to remain in the US during the times of your studies. Tourist visas are only good for up to six months, so that only works for a class or two. Most are on the F-1 visa as a full-time student, or the H-4 if their spouse is on the H1-B visa. They cannot work with the H-4, but they can attend school.

You do not have to be a US citizen to be a nurse in the US, only have a document that you can legally work here. Remember that it takes five years with the green card before someone can apply for citizenship.

Many physicians that trained in their countries and then come here for the residency do so with the J-1 visa, and that requires that they leave the US for two years when they finish in many cases. They need to have an employer as well to start the immigration process.

Most J-1 visas are not renewable and you must leave the US for a period of two years before you can return. You cannot work with the F-1 visa, that is strictly for students.

With the F-1, the best that the nurse could do is work 20 hours per week, and that is with the CPT. Definitely not full-time work. I am not going to bother even looking at that website. Any time that there are shortcuts like this, it causes trouble for the nurse. Not worth it for any reason what so ever.
