Adjustment of status

Published

Hello Suzanne and everyone out there:

I have a few questions I think you may be able to help me respond.

- I will be sitting for the NCLEX-RN on November. I am on a tourist visa, my

I-94 will expire on 11/24. Do you know if it is possible to request an extention for stay at this time?

- Also, if I pass the NCLEX-RN how long does the adjustment of status process takes?

- If I have to go back to my country (before the I-94 expires, in order to keep a legal status in the US), from your experience, what is the appropriate time to re-enter the US?

Appreciate your help,

Regards

Dear suzanne,

I am a RN here in USA and currently on H4 visa. I could'nt find a hospital or a nursing facility that would like to sponsor me for my green card yet.I went for many interviews and all are looking for green card holdders. My husband recently applied for the green card by his university and I included as a dependant. Actually it will take 3 or more years to get the green card. Is there any possibility that I can get my EAD based on this situation? Because I have read in a different article about obtaining EAD based on a green card prosess related to a family member. Please give me some advise if you know. I will really appreciate your help.Thank you .

Not usually available to you in this circumstance. Currently, even if you find an employer, not one thing can be submitted for you to get the EAD due to the retrogression as an RN.

With your husband's petition, it is not an immediate thing that it would be with the petition as an RN. Best bet is to speak to the attorney that us handling your husband's petition.
