Hello Suzanne and everyone out there:

I have a few questions I think you may be able to help me respond.

- I will be sitting for the NCLEX-RN on November. I am on a tourist visa, my

I-94 will expire on 11/24. Do you know if it is possible to request an extention for stay at this time?

- Also, if I pass the NCLEX-RN how long does the adjustment of status process takes?

- If I have to go back to my country (before the I-94 expires, in order to keep a legal status in the US), from your experience, what is the appropriate time to re-enter the US?

Adjustment of status process takes 90 days. If you were able to get everything done, you would have to wait at least this long before getting your EAD papers. Do you have an employer lined up yet?

My best recommendation is to speak with an immigration lawyer..........if you need the name of one I will be happy to send it to you. Good luck......... :)

Thanks for responding. I actually have a verbal agreement to sign up with an employer, but no contract has been sign yet until I have a pass NCLEX.

Do you already have a Visa Screen Certificate? If not, you will need to have one to attach to your papers for a change in status, if you are currently in the US. Once you have passed NCLEX and your English exams, it usually takes about four months for you to receive the certificate. You will not be able to get papers orcessed for working until you have the certificate actually in hand. Then it takes about 90 days to receive the EAD letter, which allows you to work.

Not sure if you have completed any of the exams yet.................????????

Hi Suzanne, Yes I have the TOEFL and TSE completed, have my Credentials evaluated by CGFNS, my visa screen cerfication paper work process was completed (school transcripts,etc submitted) all is pending is to have a pass NCLEX test, which I will take first week in november, for them to issue the certificate. Do you think it will take the same 4 months?

Is it true that if my I-94 is expired, I could stay in the US if Iam on adjustment of status? Do you have names of immigration attorney I could contact.

Your problem is that you must file the change of status before the deadline. You will not be able to file without the Visa Screen Certificate, and that takes about four months for you to receive it, epsecially since you are taking the NCLEX exam and not the CGFNS exam. You must have a copy of the Certificate attached for it to be processed.

You can remain in the US on an adjustment of status, but unfortunately, if you are doing things legally, you must now submit the Visa Screen Certificate with the application.

I am just waiting for a response from him, I accidentally wiped out the memory on my PDA on my flight over and lost many numbers.

if you came to the US as an LPN (educated outside the US, already passed the NCLEX PN & IELTS) with a tourist visa. is it possible that you can adjust your status considering you have an employer to working visa or immigrant status?

The LPN is can't be petitioned for a grencard whether it

be through AOS or consular processing. Also doesn't matter if one has passed the NCLEX PN already. Pls. see Suzanne's "Primer" Sticky on top for details and do a little bit of a search in the Phil. nursing forum (http://www.allnurses.com/forums/f235) as it was extensively discussed there.

Only way to have a greencard if an LPN is to get it on another route. Definitely, not thru employment-based petitions.

The other thing that you are not including is that there is no adjustment being done for nurses at present, even as an RN. There are no visas for nurses.

But as mentioned above, with the LPN, there are no visas available for that, even if you went to school in Canada. To get a visa to work in the US, it requires the RN after your name.

I am a RN here in USA and currently on H4 visa. I could'nt find a hospital or a nursing facility that would like to sponsor me for my green card yet.I went for many interviews and all are looking for green card holdders. My husband recently applied for the green card by his university and I included as a dependant. Actually it will take 3 or more years to get the green card. Is there any possibility that I can get my EAD based on this situation? Because I have read in a different article about obtaining EAD based on a green card prosess related to a family member.Please give me some advise if you know. I will really appreciate your help.Thank you .
