AC 21 change employer

Published

Hi, guys! I've worked in my hospital for 2 years. my contract is up:). My I-140 approved in 2006, and I-485 been pending for more than a year. I talked to my lawyer and she states that I can change my employer any time. The quetsio is: can I work as a traveler nurse for travel company picking up 3 month assignments (full time). Will that be considered the same job since I work as RN and in a hospital settings but through the agency? I would love to hear Ms. Suzanne opinion but I appreciate all of your responses:).

I have not seen anyone that has had troubles provided that they met the requirements for the green card to begin with and that the first facility did not cancel things on them. That is something that can happen.

The issue is that travel companies, at least the ones that I am very aware of will not consider a nurse without an actual green card in hand, unless they are a Canadian and have the TN Visa. With the EAD from AOS, you still need to have the new employer pick you up as their new employee and complete the required documents and that is where you are going to have issues. You are not going to find one that will do that.

Sure, there are those that will take you with the EAD, but will do nothing for you when it expires and that happens on a yearly basis and then what are you going to do? Make sure that you find out exactly what they will do and not do and talk to someone that actually deals with this issue and not just a recruiter.
