Hi, guys! I've worked in my hospital for 2 years. my contract is up:). My I-140 approved in 2006, and I-485 been pending for more than a year. I talked to my lawyer and she states that I can change my employer any time. The quetsio is: can I work as a traveler nurse for travel company picking up 3 month assignments (full time). Will that be considered the same job since I work as RN and in a hospital settings but through the agency? I would love to hear Ms. Suzanne opinion but I appreciate all of your responses:).

Your problem is that you are not going to find a travel company that will take you without the green card already being in hand.
I know that you can change employers at this time, but every single travel company that I know of requires the actual green card in hand before they will even consider you.
They accept work permit without any trouble. I've talked to American Traveler, Intelistaff and PPR, -any problems, since I can work anywhere with work permit. My problem is : does immigration care if I work for travel company since it is kind of full time job but not really? Do you know how to file AC 21?
As long as you are their employee full-time, but they have to be willing to do the paperwork for you since you are going to be changing employers. And this is what they are not going to want to do, and this is the point that I am trying to make to you.
They may be accepting because you have the EAD, but to do the paperwork that is involved for them.
Any of the paperwork needs to be done by an attorney, there are too many little nuances that need to be very correct on this. And if they were willing to accept you, then this is something that they should have offered to do for you.
Suzanee, thank you so much for your quick replies:). What kind of paperwork? Everything is filed by my first "petitioner" hospital. What I anticipate I will need from them is RFE-job offer. What have you heard about Intelistaff and Country Cross? I 've seenyour posts in travelers blog, do you have any information about them? What do I need for AC21? Thank you so much:)
Sent you a pm already, just look for it.
Anything that needs to be submitted needs to be done by their attorney, it is more than just one piece of paper; that is for sure. You are now changing petitioners and that is where you are going to have problems with these travel companies. Not one of them is going to want to assume being the petitioner and that is essentially what happens.
You may have spoken to a recruiter, most of them have no idea about any of this to begin with. And can actually cause you many problems.
I guess I do not understand the concept: do I have to be petitioned again? No, right..Petition already filed, and I-485 is pending. I have to stay in the same field being RN. There is no more petitioning has to be involved:), is it?

You might want to consider carefully if you ever intend on citizenship in the United States. We have read that sometimes if you don't stay with the employer that petitioned you for a year past the time you receive the green card that you may be denied citizenship down the road. I would check with your attorney on that to be sure before making a decision.
It sounds pretty bad. I wonder why if they issue the law, and they count it against you? What would be the base for denial in this case? People who use AC@21 do not violate the law, they do not do anything illegal. Does anybody, actually, used AC21? Can travel company be used in this portability law?

I have never heard on having to stay with employer for 12 months or it will affect citizenship later on.
I think, Silverdragon, that it does not make sense if immigration does it but there are a lot of things that do not make things we see....I just wanted to know if anybody ever used AC 21 with traveler company? or any hospital or employer? What kind of paperwork is involved?
You might want to check out www.trackitt.com. I have never checked it out but my husband reads a lot of comments from others on there and a lot of people post their experiences there. My husband says people have posted their experiences with AC2. He says you should be fine as long as you applied for AOS and don't leave your employer for 180 days.
