In response to your post.. I graduated in August of 05 from LVN school . In March of 05 I filed a declatory with BNE of Texas. I have had to send more and more paperwork, and have been waiting for a spot on the Elegibility and Discipline Board meeting since August. The last "unofficial" word was that I should go before the Board in February of 06. This is a very lengthy process.. the Board is backlogged with cases and is very thourogh in the paperwork. My filing is for a depressive disorder. I had classmates that have had to go for psych and polygraphs. It is a VERY frustrating process , and the one advice I have for new or current students is file asap, and expect at least a 6-8 month wait.

I applied to the BNE last February and received by DE in May.. about 4 months. I only needed to clear up a misdemeanor offense that occured over 25 years ago though.

Well, I have never been arrested, no mental problems or drug problems, or anything that they ask on the declatory form. I was on probation as a teenager for running away but it is not on my criminal record or anything. Does anyone think that I should be worried about it. If I leave it as and they find out when I graduate will they still let me go to boards after I turn in everything or is this my only chance to get it done?

Have you asked your instuctors or program director about this? I would ask them to contact BNE enforcement and see if you even have to submit one. And you can file it even after you graduate , however it takes a while to get approval from the board so if you do have to file i would get it in asap..

Are you sure it's not on your FBI record?
You can find out by requesting your own record.
Instructions on how to do that are here:
    http://www.fbi.gov/hq/cjisd/fprequest.htm

    From that page:
"All arrest data included in an Identification Record is obtained from
fingerprint submissions, disposition reports and other reports submitted
by agencies having criminal justice responsibilities."

Could you please be a little more specific about what you mean by "clear up?"
Because at first glance that sounds the BNE required legal action - or do you mean they just wanted further explanation?

No, I didn't have to take a polygraph test, why would I?

I sent my declatory order application to the BNE at the begining of January to clear up a class B misdomener from 10 years ago when I was 17. I will let you know how long it takes for me to here back from them. I am hoping I get it back before June because that is when the college has to have it or they won't let me start the ADN program. If anyone has sent a declatory order th the BNE recently please let me know about how long it takes.

OK here is an update. I e-mailed the BNE to find out if my application was recieved and they said it was processed on 2-6-06 and sent to the enforcement board for review. So that took about a month. Now I guess I just wait for their decision. Hopefully it wont take to long!!!
