I just wanted to post some info about the California BRN and dui's since there isn't a lot of information out there. In my 3rd semester of school I made a stupid decision to drink and drive. I got caught and received a misdemeanor. I graduated in December and was initially denied the chance to take the NCLEX. After receiving a letter from the board I opted to go into a stipulated agreement with them. From there the attorney generals office drafted a statement of issues and sent it to the board. It took about a month but in the end the brn dropped the charges against me and is allowing me to take my nclex. I think what helped me was being honest and persistent. So don't let the process get you down and press on.

hi.... I studied long and hard for my nclex for 3 months and gave it in April. The day after giving my exam I thought I deserved to go have dinner and some wine with a friend since I had literally not stepped out of my house in months. I got dui that night, my blood alcohol came out to .18 which was impossible because I had 2 glasses of wine about 2 hours before driving with dinner, I wasnt in any way or form intoxicated when I got behind the wheel because if I was I would have never made the mistake to drive. I am a petite person but even so .18 is really high knowing I had wine 2 hours ago that too with food, so I decided to fight the case. My lawyer had an expert look at the report and he noticed that it was incorrect and had the report also took 2-3 months to come in, and I know for a fact that It wasn't correct plus I had passed all the sobriety tests. But 4 months later and extending court dates, my court date was today. For my lawyer to bring in her expert i needed to go to trial which meant a lot more money and time, and outcome changing were still slim so I chose to stick to the 1900$ 3 yr probation, 3 month dui classes, and 8 days workshop. Im really scared on wat to do now cuz a month after the dui i had gotten my result on my nclex and i had passed but the boards did not send me my license, its human nature to make mistakes and I obviously made a huge one. being a nurse has always been my dream and I know .18 is extremely high. Can u please give me some advice on what i should do about the boards, who I should talk to or what I need to provide to get my license. Also will I ever be able to get it?

I had a midemeanor DUI from April 2012. My BAC was 0.12. I graduated in May 2013. I just received my ATT via e-mail from Pearson-Vue. With all obligations completed except probation, all fines paid and no other criminal history what should I expect next?

Checked my "snail' mail today I'm all cleared by the BRN. However, this seems not to be the trend with most of the respondents of his post. It took the OP 6 months to test and 3 1/2 months for myself. In addition to all required documents to supplement the application for examination, I included a cover letter and resume related to my years of civic duty.

I just got my statement of issues from the attorney general the end of August. Basically it is a legal document that states the board's case against me and my license. I agreed to settle rather than go to court. A hearing would be 8-10 months away and the outcome would likely be unfavorable anyway. The board offered me a settlement about 3 weeks after the SOI. It is the standard agreement that they give to most offenders, licensed or not yet licensed. I blew a .24 so I got all the standard stipulations plus most of the extreme ones. These can be looked up on the board's website. 1-19 include 3 years probation with drug/alcohol testing, counseling, physical and mental doctor's examinations, mandatory nursing classes, supervision as a RN from another RN. You cannot work in home health or any temp agency, flight nurse, or any job where someone would not be able to supervise. You can also not be a supervisor or in charge of anyone else's job duties. You promise to obey all laws, not take any mind altering substance including alcohol, work as an RN under supervision, take the classes, counseling and anything else the Dr or shrink advise. There is a monitor assigned to you that follows your progress and can make changes to the agreement as you go depending on your progress/ reports from Drs, boss', drug tests, monitor ect. Nothing you have already done counts towards any of these things. It must all be done again so the monitor can track it. I agreed to these terms and now I have to wait for the board members to approve the deal, which they only meet about once a month. At that point I will get my license and be assigned a monitor to begin my probation agreement.

Sunflw37 - Did anyone at the AG office contact you before they sent you your statement of issues? I had been denied in August and sent my appeal in a week later. They contacted at the beginning of September saying they needed a written and signed document for my appeal. I overnighted it to them, but from what I have heard, it may take three weeks for my case to be assigned to an attorney. I am freaking out because the board denied my CA nursing license for a drinking ticket I had five years ago. I have since had the charge exonerated - meaning I was found innocent of the drinking ticket & was pardoned by the state. Therefore, it is illegal for the board to use the charge to discriminate against me. I did not think I would have to go through the appeal process since it was a mistake by the board. Long story short, I started graduate nursing school in Cali because my lawyer said it would not take long since we do not need an appeal, but we did have to appeal. If I do not have my license by Dec I am dropped from my program... I am freaking out because I moved across the country to pursue my Masters and now I might lose everything. I am so desperate, I might drive to Sacramento to see if I can talk to someone. Just looking for any advice anyone has on the appeal process!!

This message is for sunflw37...I signed my respondend letter in August, 2013 too. I heard it take anywhere from 3-4 months for the board to contact me. It has been almost 3 months now. Hopefully I hear from them soon. If it's approved on a vote, a probation monitor will notify me as to what I need to do next. At the meantime, I'm freshing up on my skills. I highly recommend you do the same. Most of my friends that are nurses for the new grads program are not up to date on their skills. One thing they recommend is to go over it. One more thing, even though I do not know the outcome of my situation. I had attended a nurse meeting, really helpful. There are people that have been nurses for over 20 year plus that is going through the same thing we are but with the exception they are practing and some are not. Try attending one in your area. Look on the board website under diversion. They can you tips what is expected from the probation period. Hope that help and please keep me inform.

Today is Nov.6 2013. I finally got my respondent letter directly from the BRN. My case got approved. My probation start Dec. 3, 2013. Since, I did not pass my nclex. The board will forward my application back to licensing so I can retake my test again. Once I pass, a probation monitor will either contact me by letter or phone as to what I need to do next before my license is issue.

sunflw37 and lysosome - have you guys heard back from the BON regarding approval of your stipulated agreement? I'm still waiting for mine and am wondering how long it took you guys. Plz let me know! I can't take the wait any longer!

Hey I saw your post about applying out of state, any updates on that topic? I was arrested in March 2014, and am graduating in May. My court date is in June. I'm looking into applying out of state for license, I am wondering how long it take to receive your att and license out of CA, and what the process is to work in CA or apply for a CA license afterwards. Any help would be greatly appreciated! Based on many of the stories of students in CA who receieved a DUI during nursing school, it looks like I'll be denied and will have to wait a while to be licensed. I want to do whatever I can to be able to start working as an RN right away. Also, since I am not technically convicted until my court date in June, is this something they will see through my fingerprints? Will they even look at my application until my court date? Has anyone had luck with lawyers or attorneys? Thanks to anyone who can help me!!!

Hi, I am graduating this May, and was pulled over for a DUI in March. my court date is not until June 26th. Technically, I have not been convicted, so I am unsure of whether I should disclose this information or not.. on the BRN website it requires that I send in court documentation, which I obviously dont have. I am trying to decide on whether I disclose my DUI on my application or wait until my conviction. Since my court date is only about 5 weeks after graduation I am unsure if I will recieve my ATT that time, and I dont want them to say I was dishonest on my application by not discussing my DUI. If I disclose my conviction, submit letters of reccomendation and a personal statement, I am worried that it may prolong the process and they will not look at my application until I provide court documents. I cant afford to not have my license, I have a lot of bills and student loans. Any advice?

JasmineJoy I hope you disclosed it because the arrest itself shows on your background check. Yes your application will be delayed but if you lie you will have to reapply in a year because you will absolutely be denied.

Hello everyone I am looking for some guidance since no one I know is dealing with this. I just recently graduated but received my dui the first month of this last semester in nursing school. I have not submitted my application to the board yet but want to do it within the next week. I have not been convicted of the dui yet but I will be so I do plan on disclosing this to the board because I know they will deny the application and make me wait longer if I don't. I have already written my letter explain the circumstance of the dui. I have the copy of the police report ready. What steps do I need to take now? If anyone can please help guide me that would be great could really use the advice. I was also wondering about the character letter I have multiple instructors and outside nurses waiting to write these for me what exactly is to be included in these and do I send those in with the police report and statement letter? Thank you in advance this has truly been one of the worst experiences I've ever put myself in I've never felt more disappointed and defeated in my life.
