I have N arrest and unbable to get a nursing until case closes

Nurses Criminal

Published

In July I was fasley arrested for assaulting a family member. This is all from a custody battle over a child. ( not my child BTW) But this person placed a complaint accusing me of something that I didn't do. Just to be spiteful. This happens days after I got accepted at an agency for home health care. Long story short they found out about the arrest and said they won't hire me until I get proof stating it was a false arrest. This guys has not shown up to testify for trial and no one can find him. January is going to be my last court date. If they cannot find him by that DTE the case will be dismissed. My question will this agency actually hire me even if it was dismissed? They might look at me like I am a criminal and say how did she get herself into this position. I really want to work there . I have never worked as a nurse. This would be my first LPN position. Just feeling hopeless because of this . Its not fair.

Hi and welcome to AN, the largest peer to peer nursing community.

While I can't answer your specific question, I'm sure someone will be along soon to help you.

I have moved your post to Nursing Licensure with Criminal History as you might need to explain this situation to your board of nursing.

You've been 'accepted' but not hired? I supposed the employer is free to choose, but since you were 'accepted' that ought to keep the door open for you. There aren't any guarantees, but there are other jobs, worst case scenario.

No it's not fair at all. Here's the thing -- now that you are a nurse with a license, you'll want to preserve what you've worked so hard for. It won't undo this but it will give you reason to, for instance, avoid certain people, situations, and think twice about a lot of stuff. That's life with a license :) Try and see your situation from a more empowered perspective, make it one of those 'learning experiences' everyone hates but gets whether they screwed up or not.

Thanks for the advice. It has been hard but I am sure the case is going to be dismissed. And yes I have to be careful who I involve myself with now that I have a license.

I have benn hired , I went to orientation and filled out paperwork. I just hope they will give me a chance despite all of this.

Be sure to keep all of your court documentation if, and when you may have to present proof to the BON. Followed up with a history of your custody battle. They may want a letter of explanation in your own words r/t the arrest, which may need to be notarized. Your right, nurses have a licensure to protect. Think of it this way, you utilize skills, and talents to assess patients changes, conditions to protect their well being. As a nurse you will get accustomed to using these skills to protect you, yours, and your profession. Good luck to you, and welcome to nursing..........Peace.

So you were Arrested, but no charges were filed, so you were dismissed. So you technically only have an Arrest in your record?

How did your employer even get to know about the Arrest? -- just curious.

Im going through the sample situation with my sister
