modification of probation - rule out clause

I understand that the rule out clause is usually given before you start probation so that you are exempt from testing if approved by a specialist, however

I was wondering has anyone asked for a rule out clause DURING probation? like at the midway point. At the 2 year mark of a 4 year contract, I was planning on asking for a modification of my drug testing through a rule out clause.

If you have any experience or know of any stories regarding this go ahead and comment. Like do I get to go before the board and plead my case? Or do they just look at the paper work.

Some of you may or may not agree with me, but I don't think that a DUI that happened prior to becoming a nurse should require you to test for 3,4,or 5 years.

Personally I don't think a DUI that happened before you became a nurse should be any issue. In addition I don't think a DUI that occurred WHILE you were a Nurse should make you subject to this nonsense unless it can be shown that it had an impact on your ability to safely practice in specific terms (IE "this nurse was drunk, hung over, smelled like booze at work....)
