I was eligible to sit for the nclex for California.

Wow.. so I took my exam this September, went the distance all 265 questions. Unfortunately I didn't pass. Got my results and "near passing standard" all across the board so the news of failure basically tore me apart.

Now what makes it worse is after submitting the reapplication form and waiting for four weeks for a reply from the board, I get a letter today stating

:::: The Board has determined that the program you completed in the Philippines is not equivalent to the minimum requirements for licensure set forth in California Code Section 1426(d).

You may be able to view Section 1426 (d) and all other codes of the California Code of Regulations by going to our website at: www.rn.ca.gov. Once in the website there will be 'Tabs' at the top of the screen. Go to Regulations then to Nursing Practice Act and finally to California Code of Regulations.

California Code of Regulations Section 1426(d) states that theory and clinical practice shall be concurrent. The documents received state that some of the training was completed several semesters after the theory classes. ::::::

I email the evaluator in charge of my application and she explains ::::

You have options and that is to apply to the LVN Board or in another RN Board in a different state or go for your master's degree in nursing but in California you are not qualified as a RN without the Master's degree.

According to the RLE and the school's curriculum you should have completed the scrubs in NCM 101 and 102 but they were completed in NCM 104, 105 and 103. I am enclosing a copy of the letter that was sent to you yesterday.

I'm angry and sad at the same time. How is it possible that I was eligible to take the nclex the first time I applied and not eligible to retake now? I went from meeting the requirements of an RN to now meeting the requirements of an LVN. How is this possible?

They are saying I'm ineligible based on the dates of completion of my cases. The school requires 5 major, 5 minor, 5 assisted delivery, 5 actual delivery, and 5 cord dressing clinical cases which I completed or else I wouldn't have been able to graduate. All of a sudden Ca board is being technical about the completion dates of these cases. The school is well aware of the fact that completion of these cases is impossible to be concurrent with the theoretical classes. It is not always guaranteed that students will complete the needed cases in concurrent with the theoretical because there are times when there aren't any patients in the hospitals that we are rotated in. It is for this reason that the school allows completion of the needed cases through out the following semesters. We took the theoretical classes before we were allowed to go on our clinicals but the lack of patients made it difficult to complete those 5 cases during that semester. That's why some of my cases were completed one or two semesters after the theory classes.

Am I understanding this correctly? I thought all that matters was that my cases were complete regardless if it was completed in concurrent/along with theoretical or after theoretical. I learned what I was suppose to learn it just so happen that exposure to the actual thing came a semester later.

So now they are saying I can't sit for the nclex in California and I need to complete a masters degree to be qualified as an Rn in California. Is this possible? I went to school graduated with a BSN and in the end I'm told that I only qualify to be a LVN after submitting a reapplication for nclex. .

Clarification would be nice and I would appreciate any advice. This just makes me question if nursing is even the right fit for me cause it's been obstacles after obstacles.

i think im gona be having same prob when i submit my additional requirements to the BRN... how come no one has a good news????

hi.. all i know is that I've been reading threads about this issue and so far no one yet given the eligibility to take the exam from foreign applicants. i know that its hard to complete clinical cases during that time when im still in nursing school.. too many students and school competing to complete their cases required for PRC so what happened is you will get a case but not on the particular dates.. and CA-BRN will not going to give u information on dates where u supposed to do clinical in relation to your theory.. only the school and the BRN will be communicating in these matter..

HOPELESS case. its a dead end.

believe me I have done everything, and right now Im just applying at Nevada. Im done with California, too much stress and hassle. I have always had problems from the start with them. They're too strict now.

i thought you said you have resolved your case with the CA-BRN? I read in a thread that you talked to your analyst..Was that for your prior application? Please enlighten me. Thanks

i have the same problem, same letter i have received from BON last december 2, 2011. i am so sad and down the time i received that letter regarding the concurrent issue. i keep on tracking this forum fr. time to time, and waiting someone who have received an approval regarding there application, but until now no one has granted yet. december 17, 2011 i tried to send a letter to my evaluator, asking why this happen and ask what i am going to do but she did not reply. January 3, 2012 i called my evaluator a lot of times that day (it's hard to contact BON, the line is always busy) first i leave a msg. to my evaluator, second time around i leave again a msg. to my evaluator, i keep on trying until 3pm i receive a phone call from my evaluator, telling that she did not forget me, and that she is busy with many applicants. Finally i spoke to my evaluator, she told me about my situation regarding the concurrent issue with my theory and clinical. She also told me that i can apply for LVN because there is no concurrent issue on it, but she said to me that a lot of applicants with the same situation educated from our country since 2005 up to present has a problem with concurrent issue, she told me that i have to be patient because the board will work on this issue, and decide whether they have to consider it or not, and that the result will come out within a couple of weeks, she said "if the result will come out then i will email you or write you a letter about it". My evaluator talked so nice and understands my situation. I did not lose my hope and believe that God is my hope and He is working on it. It is not yet the end, while our dear Lord God is always with us we will never give up and continue to fight the battle for NCLEX. To my fellow applicants of BON Ca. i keep on praying for all of you, never give up, let us continue to pray that the Lord will enlighten BON. Whatever our God's will then we will have to follow. God bless everyone and keep praying hard...

Hi, I have the same situation with you guys. I talked to the evaluator in person and she told me the same thing that she said with you guys. I decided to move to other state for now until the decision from the BON is made. I'm praying that the BON will make up their mind and consider our case. Please keep in touch everyone. I will keep on tracking this forum and i will share with you guys if there's an update about our status. :sniff:

If your basic nursing education meets Californias requirement then you should be eligible. What they are evaluating should only help you not hurt you. It doesn't make sense to evaluate your education beyond the basic minimum requirements and count it against you. They should consider it an extra and deem you eligible. Unless it is something beyond where they found discrepancies and therefore evaluating the whole education and if found any part of the nursing education isn't concurrent with theory. Either way it shouldn't matter if clinicals aren't concurrent with theory as long as they were completed. At least that's my opinion.

hi laela... are you considering to take an LVN??? so your cases that you submitted to CA-BRN are the one from PRC??? did they also ask for an explanation letter from your school?? if the dates are the concern??? thanks for sharing your situation!! hope they will consider the requirements even the clinical cases are not concurrent to the theories which is the issue here. about mine, my mom still working on my PRC forms she went to the hospitals where i completed my clinical cases and look the chief nurse and supervisors. hope to see a silver lining!!

@ melai12, my cases i submitted are not from PRC, right now I just have my faith and in trust everything to God....

Hi! Was planning to do the same thing too. But after everything that happened (same case as yours), the ca brn website is like my facebook page, it's bookmarked, and all that. I check it all the time and kept on reading their rules. One of them regarding endorsement is this..

To qualify for endorsement (reciprocity) into California as a RN, you must hold a current and active license in another state or Canada, have completed an educational program meeting all California requirements, and have passed National Council Licensure Examination (NCLEX-RN) or the State Board Test Pool Examination (SBTPE). The Canadian Comprehensive Examination is not acceptable. If you do not possess these qualifications, you do not qualify for licensure by endorsement and must apply to take the examination instead.

This held me back. What if they tell me again that I'm not eligible? This time for endorsement because my education, again, does not meet Cali requirements? What do you think? Oh my God, I wanna move to another state just to get a license! :/
