US Regulations

Has anyone heard about these new regulations the US is requiring for foreign nurse, including Canadian to have? I just heard the tail end of it on the news today. I am living in Michigan so probably won't be affected by it but I am concerned about my fellow Canadian nurses. With the nursing shortage being so acute and will be worse in the US, doesn't seem a smart thing to do.

Any comments or information?

Canadian nurses still have to write the NCLEX and register for their lisence, and they can still work on a TN visa (NAFTA). The only new thing is they must complete a visa screen which can take a few months if they are entering and starting work in July or later. If they entered before and are on a TN visa, they have one year to complete the visa screen. After that, if they leave the US they will not be allowed to reenter. They can stay in the US and work on their TN visa without getting it done, but then they can't reenter the US if they go home for a visit.

As was stated above, the biggest thing will be getting a Visa Screen completed. You may just be hearing about it now, but any Canadian nurse working in the US has known about this for well over one year. If they chose to ignore it, then it is their problem. This is not something that was just decided yesterday.

So sit back and relax.............. :balloons:

Also, any nurse from Canada working under a current NAFTA TN visa will be grandfathered in over this next year, meaning that they will be able to return to the US without having completed Visa Screen but only until July, 2005. However, any new TN will only be issued only if the nurse has a Visa Screen Certificate.

hmmm this is new to me... i am actually going back home (in between assignments) for about a week.. so just to make sure.. *US immigration will let me back in without my Visa Screen?*; i already have a valid TN Visa for this year. so the july 24th (26th?) cut off date to go home and back without the Visa Screen has been replaced by the july '05 date? i dont want any problems crossing the border. :uhoh3:

Yes, they will let you back in. But after July, 2005, you will not be allowed back in without the Visa Screen Certificate. To renew any TN Visa will require you to have a Visa Screen Certificate.

Have a fun trip................ :balloons:
