I-140 not filed yet!

Hi Suzanne and all,

I just found out my petition has not yet been filed, I don't know if I should be angry, upset, disappointed or what. Here's the deal. I signed a contract with Florida Hospital a month ago and met face to face with the Immigration Lawyer. I handed over all the documentation that was required of me and believed that I just had to sit tight and wait for approval now. Those of you who know me on here, I've never sat back and waited patiently, I always follow up and ask for an update regularly. I just emailed the lawyer for a progress report and this is the response I got :

"There are employer data required that Florida Hospital has not provided yet. Florida Hospital is creating a separate department for international recruitment to streamline the human resource/international recruitment process. Let us give them a little time. I am on top of it."

I don't get it! When I was out there last month, they were jumping thru hoops to try to get me over there and working as soon as possible. And now this! A month totally wasted! Yes, I think I am angry :angryfire

What do you think I should do?

How much longer did the attorney say that you should wait?

This is something that easily could have been done already for you. The paperwork from the hospital is actually quite simple for them to take care.

Perhaps give them a call, especially the person that you met with? They may have no idea about any of this.

I am sorry to hear this Tina..and I know it is no consolation but it doesnt surpise me either...I have found this whole journey very frustrating and having to check up on people all the time - even make a nusance of myself to make sure things get done...as Suzanne says perhaps give them a ring there may be a link out of the chain somewhere or someones memory needs jogging..keep us up to date...really feel for you ((hugs))

I don't know what to do now. My wife is now pragnant and still I am waiting for l140 approval. Information regarding this matter is highly appreciated.

As of June 21, 2005. Nebraska is processing applications for Schedule A workers filed before Dec 11, 2004. Since your pd is April 2005, then you still have to wait a few more months until their processing time reach your pd.

About your wife being pregnant, you can still bring your child as an immigrant provided that by the time you submitted your ds-230 froms to NVC, your child's documents is along with it. If your wife delivered the baby after you submitted the forms , then that would be a problem, in my own opinion.

I think your immigration lawyer knows what steps to take to handle the problem.
