I am paid per visit and have short term disability through my work.

*35 visits per week to maintation full time status.

*I also have an hourly rate of pay that I make when I am on vacation, etc.

Recently had a vehicle accident and unable to work for a time.

My understanding is that short term disability pays 60% of your income. According to my company it is their policy that they provide to the STD insurance company that I only make the amount of 25 visits a week and I get 60% of that. That is less than half of my net income a month....and no where close to 60% of my gross.

Is this legal? What can I do? I am going to loose everything and have to file bankruptcy.

This sounds like more of a legal question than a nursing one. Have you tried talking to the STD people for guidance? The state you live in may also matter. If they're not helpful and the stakes are "everything", seek legal advice. Good luck to you.

As I recall, it was based on my quarterly income. I cannot remember the periods that were used, something like 6 mos and 12 mos back. It had nothing to do with my rate of pay, hourly or PPV but my actual income. And it was 60% of that.

The Employment Development Department (EDD) calculates your weekly benefit amount using a base period. This base period covers 12 months and is divided into four consecutive quarters of three months each. The wages you were paid approximately 5 to 18 months before the disability claim begins are included in the base period (they must have been subject to the State Disability Insurance [sDI] tax). Your base period does not include wages paid at the time your disability begins.
