Overtime not paid at time and a half? Is this common?

Recently I was told the facility is reducing overtime pay to 1.00/hr on pay rate for overtime hours, not paying time and a half for hours worked. Is this legal? Is this common? I cannot believe anyone will work extra hours, given the amount of work that needs to be done, and not compensated better. I understand overtime does not start until over 40 hours, but I have always been paid time and a half for every minute over 40 hours. Now this? I need some input please.

one advantage to EMPLOYERS of the 3x12's is that there is a cushion before overtime would be due.....36 hours maybe considered fulltime FOR THE PURPOSE of accruing benefits, but not under the overtime law.....

Unless there's a contract, your employer has the right to schedule you at will.

How has President Obama hurt nurses?

Don't get me wrong, I think President Obama has done a really good job so far and feel he really is trying to make a diffference instead of being a figurehead. What I mean is at least where I work, everytime he says anything about healthcare changes, the powers that be start changing things and it has so far worked out to the disadvantage of us nurses.How else do you explain a hosp decision to lay off all LPNS unless they want to work as techs?I have worked with LPNS {especially as a new RN} who taught me so much, I just think all nurses are going to bear the brunt of any attempts to change healthcare.

I can't explain your employer's decisions, nor the idea that your employer makes decisions based on changes that have not been made, are only proposed, and appear unlikely to be passed in this session. That's a curious way to do business.

It was the Kentucky River ruling by Bush NLRB appointees that resulted in many nurses being declared ineligible for overtime, the topic of this thread. Obama has so far voiced dismay at the idea that we need to import nurses from other countries and has called for increased funding to nursing schools to improve instructors' salaries.

Maybe , our economy is worse here in Tennessee but big changes have already taken place at the"physcian led" hospital system I work for and none have been aimed anywhere but the nurses and support staff.The daily 25 ft free buffet for the docs while they are doing their grand rounds is still there, nurse managers still have their associate clinical leaders ,but the nurses are having more pts with less support or getting laid off, losing overtime, losing free benefits, paying more for insurance etc.So, thats why I think it will be even worse for nurses when President Obama does make changes{which are badly needed}

In response to BADPHISH (above)...I have reason to believe that we are all happy to have jobs but that doesn't mean that we should allow them to cheat us out of overtime pay which the Wage and Hours LAWS (Fair Labor Standards Act) state are due to us!!! Unfortunately this sort of mentality is why they continue to give us the shaft! Why is it that so many nurses seem scared to stand up for their RIGHTS? Learn the laws, bring them to the attention of your

work place, even if done by an sending a copy of the laws to your Human Resources Dept, and if there is no resolution, get in contact with your states wage and hour division and they will do an investigation free of charge. If found guilty of breaking the law they WILL make them pay and stop their cheating ways!

I work in an O.R. that has no 3-11 p.m. staff, nor an 11-7 a.m. staff, therefore our 16 hours of call begins at 3 P.M. after working an eight hour day. Frequently, there is more than one room running past 3 P.M., so additional staff is needed besides the call team to finish the scheduled cases. We are reimbursed in "time" rather than $$ for the O.T. For example, if we stay one hour late, then, sometime during that week we are told to leave 1.5 hours early. We do not punch out on the days that we leave early and our manager adjusts our time to reflect a 40 hour work week. So, our unit never shows any "OVERTIME WORKED"...... The "call team" gets paid "call pay..at time and 1/2...put that is reflected as "call $$ on the books, not overtime). Some of us would prefer the $$, rather than having time back, but, there are some people who like being able to leave early as well. Should we be given the OPTION? We are also concerned that by our department never reflecting any "overtime worked" that this may sabotage our efforts in attempting to get more staffing...or a 3-11 staff. Regularly scheduled cases continue to be booked past 3 P.M., in an attempt to increase business..which is understandable....and, with today's economy, the nurses are all willing to be flexible and do their part. We are just wondering if anyone else has ever run across this type of situation and what options we may have with regard to requesting to be paid the O.T. rather than being told to leave early during the week on another day.

Illegal period! The Fair Labor Standards Act (FSLA) states that compensatory time off in lieu of cash is not permitted. I encourage you to look up the LAWS and present them to you Human Resources Dept.

Our Adm. just got worse, he wont provide milk for the staff's coffee- let them drink water or tea.....
