I am starting a new thread to track cases from NVC - embassy to GC.

The best news for RN in China, Phillippines and India has been great and informative thread, but I think it is more appropriate and convenient if we start a new thread.

Also with the rapid scheduling of interviews for most of us, I am looking beyond the CP and anticipating the GC!

The August interview schedules are out already in India, and recently in the Philippines and hopefully in China.

Here is my case details

hello. I just want to ask also if you submit the original copy of the nbi clearance or just a photocopy. thanks

It is up to you. Better ask your lawyer. If you submit the original make sure you make a duplicate copy. If you submit a photo copy make sure that you keep the original since you will be required to produce it during your interview.

That's the best thing to do. All of us must remember that there are a lot of cases that is being process since VB is current. If everyone inquire about their own cases, how do you think NVC can answer all of them. We are only slowing down NVC's process by doing so. Just inform your lawyer that your PD is going to be current in July 1(in case he miss it)and ask for further instructions on what to do next and what documents to prepare.

I have done such thing and my lawyer reply that he will inquire about my case in July 1 and he will inform me ASAP if there are any instructions/update with regards to my case.

Renew your NBI Certificate. That is enough. But if you worked or been outside the Philippines for more than 6 month, then you must need a Police Clearance from that Country.

NVC emails are getting worse! Maybe we should give them sometime to sort things out. And the best advise we could get on what to do are instructions coming from our lawyer...:madface:

hi everyone! I think it is indeed best to contact our individual lawyers, and see what specifically is being asked by NVC. Each case is unique. A few others here stated that only "updated DS230 forms" were required of them while some are being asked of "äffidavit of support from petitioner".

For my case, I contacted agency here in PI then agency in US then the actual attorney-of-record to verify what I have received from NVC (e-mail & phone msg). Late yesterday, I was asked to download DS230 forms, fill them out again & send. I asked about other docs (certif, clearances etc) but all they said was that only DS230 updated is needed. So this week I intend to send these forms. Now should they ask for anything else, will just do later.

can i just download the ds-230 from the internet and submit it? The bar coded sheet was already submitted to NVC previously. Do you think it will cause another delay if I just send the one from the internet along with my original documents? Or should I just wait for the bar-coded one from my lawyer in case NVC sends me another DS-230 to fill up again.

Btw, I did not send any pictures with my packet 3 before. I just sent photocopy of my passport (biographical data), birth certificate and NBI certificate. I also included CENOMAR. Should I include another Certificate of No Marriage? And should I include pictures, too?

You have to wait the letter of request from the NVC as to my lawyer's advice otherwise they will reject your DS230 forms, the letter of request will be placedon top of all forms requested by the NVC to submit, just wait for your lawyer to receive that. All forms must be original except the copy of your passport, you don't need to submit any pictures. You don't need to include CENOMAR since this is not written on their requirements.

this is the latest email that i received from my lawyer. so, we need to stop contacting the nvc now, because we are just causing a delay with regards to our applications.

i read through this e-mail from you and the one to the national visa center to follow up on your case status.

first and foremost, do not complete the i-864 affidavit of support. you have been misinformed by the national visa center as to what you need in your file. if you have someone execute the affidavit of support, it becomes a binding contract and this person could one day be sued. this is a terrible risk to take when this is not a requirement for you case. do not complete it.

we will contact the national visa center on your behalf from this point forward (and as we have done in the past). there is a special e-mail address for attorneys only which is better staffed. if the person who responded to your e-mail made a notation in your file that you now need an affidavit of support, we will have to get this fixed now before we can proceed with your case because it will not be automatically forwarded for an interview now.

finally, i am rather confused as to why you felt the need to contact the national visa center in the first place. if you wish to contact the government agency yourself, although we strongly advise against it, you should always inform us first. as your attorneys, we have a right and a duty to know what is going on in the cases we are representing. in this case, you were misinformed and may have held up your case processing when contacting them without our knowledge. however, you had been completely informed of your case status beforehand and in your e-mail to them, you even stated to them that your case was completed (a definite measure of status). you were also informed that you were simply waiting for an interview and you would not be granted an interview until visas became current again. there was absolutely nothing to find out from them in the first place.

from now on, i am going to ask you to let us do the correspondence on your behalf. we will inform you if it is something you should be taking care of yourself. in the meantime, we will correct the record with the national visa center and see about having you scheduled for an interview before visas retrogress again. we will contact you if there are documents you need. but please do not contact government agencies without our knowledge.

Everything is really confusing right now. NVC does not give us an exact answer to our emails...it looks like their replies are generic. And our lawyers have different answers. But let's keep posting our lawyer's replies so we can compare if there are differences in their replies.

I agree that we should leave it to our lawyers to follow up our cases but I believe it is still important for us to be aware on to what is going on with our cases because this is what placed me in retrogression in the first place. If only my lawyer acted fast last year I could have been interviewed already last year.

I found out that they had my DS 230 from NVC May 2006 but only acted on it on July 31, 2006 then I signed the form as soon as I got it and mailed it back to them first week of August 2006 and then my case was caught up in retrogression. If only they acted on my DS230 in June, I could have been in the U.S. now.

So my advise to all. Post your lawyers replies here so we could compare if our lawyers are working fast or slow.

Hi guys! Is there anyone here in this forum with PD before June 2005? Anyone with PD that became current this June visa bulletin? Just wondering what happened to your cases. For sure by now you already know what was required to resume processing of your cases. So if anyone here has a PD before June 2005 please share with us what NVC required you to do. Thanks.

I agree agp ph, we should be aware of what is going on with our case, nothing is wrong if we contact the NVC, that is what the NVC inquiry is made for... I had the same situation as you are.... I don't want to make my lawyer feel that his strategy is too slow or something, that it why I just let him do his thing... My i140 was approved May4, 2006 and it took 4 months for our packet 3 to arrive. No hints, no clues on anything because sometimes they do not exert extra effort to communicate to their clients, they just answer you when you ask them something. And to think I paid all my expenses..(didn't go through agency) :madface:
