Taking up NCLEX exam with tourist visa in New Jersey

:DJust wanted to know if it is possible taking the nclex exam in New Jersey where my in-laws are residing, they are already American citizens. If I apply for a tourist visa for the exam, within that six- month period span of the tourist visa,would i be able to adjust my status to working visa as soon as I passed my NCLEX in the US? Would this be feasible? Or will the immigration here in the Philippines be strict about nurses now in 2008 about taking their NCLEX in the US, knowing the fact that eventually they will adjust their status. Please help me. My wife's parents,sisters are US citizens. Since there is a retrogression going on, just wondering if the US immigration will still grant tourist visas to foreign nurses. Please do some more reading regarding retrogression and such on the Int'l forum. You can start out by reading the stickies in the Int'l forum.

You cannot adjust during retrogression and if you say that reason you just mentioned to the consul in the US Embassy when applying for a tourist visa, you are sure to be denied. Hands down.

There is no retrogression for tourist visas nor does it affects tourist visas. Tourist visas are tourist visas. It is different from immigration where there are retrogression, visa caps, etc...

Also, the reason why applicants for tourist visas are being denied so much so is because of people that applied for it and never returned.

Is it possible ?? Yes, of course. That is if you were granted one and even if you are granted one, the immigration officer at the port of entry can still decide to not let you in and do an airport-to-airport, if he suspects something as well.

If you were able to get in and take the NCLEX, can you adjust status and stay?? There is no guarantee and as mentioned AOS can only be done if there is no retrogression and even those that were able to file one before does not mean it will be approved as well. They can still deny adj. of status afterwards for dual-intent.

I hope you are able to see the diff. checks and balances in place.

We do not have working visas and the green card is under the retrogression so there will be no way for you to adjust your status and remain in the US.

Tourist visas are also not issued for the purpose of writing the NCLEX exam when it can be written in Makati.

You are looking at five years plus for a chance at a green card, working inthe US before that time is going to be impossible for you to do.

thers nothing wrong in trying to get tourist visa, you can take you nclex while on your vacation, there ae 2 problems you wil encounter though how to convince the consul that your coming back and second retrogression you cant adjsut your status. gudluck
