I'd like to update you my case.(hope you still remember me) After talking with you sveral times in this June, I decided to take your advice --go for AOS. Unfortunately, the July visa bulletin made it impossible. So I flew back to Hong Kong in July. The hospital filed my petition(I140) to USCIS on 7/20 and got the receipt notice on 7/30. According to their web, they received my petition on 7/27. Could you pls tell me what is my PD? 7/30 or 7/27 or7/20??
In addition, 1 month passed, my case is still pending in Texas Service Center. I have started worrying after checking their processing time, which says they are now dealing with the cases with the notice date of 2/13/2007???--what does this mean?? The hospital attorney told me it would only take about 1 month to get my I140 approval. I feel so frustrated now since I don't know how long I should wait for my GC and when the retrogression will be ended??
I plan to go back to the States to continue my nursing education since I really want to do something meaningful to my future career. Do you have any idea whether I am eligible for F1 (Student) visa after my I140 has filed? Some people told me I would be denied for F1 visa after filing immigration petition, is that true?

Hi Alina
Your PD is the date of your receipt and if their website is saying 27/7 then I would go with that. It will take more than a month for you to get approval so not sure why your lawyer is saying 1 month. If Texas is processing Feb 07 then there is nothing you can do to expediate it as premium processing is currently not being done.
Thanks a lot for your reply, Silverdragon!! Could you pls give me some hints about how long it will take for I140 aproval gerenally? In my case, does it mean that i have to wait about 6 months to get it approved?? I have a friend whoes I140 got approved only within 3 weeks in the same certer last year. I wonder what made hers so quick?
Things started slowing down after September 06 there are threads here in the forum for both Nebraska and Texas service stations and both seem to be taking over 7 months to get approval. Someone I know filed I140 last Oct/Nov and is still waiting for approval with Nebraska. So don't look for getting it quick because I just don't think it is happening at the moment. Once you have approval you are then affected by retrogression which at the moment no one knows whats happening

If you had an F-1 visa in the past, then it should not be an issue to get another one.
If birth country is Hong Kong, then things may progress sooner for you, we will not know until the October Bulletin is released in mid-September. Would not do a thing until that comes out and we know what is going to happen with the next fiscal year.
I have never applied for F1 visa. I had a F2 in the past and a B1/B1 now.
