State regs in GA state that you must have one caregiver for every 15 residents from 8am-11pm. 11pm-8am you must have 1 to 25. I work in an ALF with an independent side. Some of those independent residents are on a 'care level' which technically makes them AL. My question is, do the other IL residents not on a care level count as residents that need the supervision in that ratio?

No expert but here it is not determined by the resident's individual level but by the building's type of license.

We have an independent living that has an AL license. To maintain the license we have to follow all AL regs and not the IL regs.

We have a personal care home license. Do you think I should just staff it at what the total census is not just AL residents?

Well the Regs say...

290-5-35-.13 Staffing.

(1) The home shall have as many employees on duty at all times as may be needed to properly safeguard the health, safety and welfare of the residents, as required by these regulations. As a minimum the following shall be observed:

(a) At least one administrator, on-site manager, or a responsible staff person shall be on the premises twenty-four (24) hours per day. Residents shall not be left unsupervised. A minimum on-site staff to resident ratio shall be one (1) staff person per fifteen (15) residents during waking hours and one (1) staff person per twenty-five (25) residents during non-waking hours;

It doesn't seem to differentiate between levels of care so I personally would maintain staffing for the entire building to the reg standards.
