Hello. I am researching a second career in home health care. If you are a home health care employee could you please tell me if you were required to a non-compete agreement? At some point I may explore starting my own firm and I would like to consider bringing my customers with me to the new firm. Could you also let me know what state you are in? I believe the rules of enforcement of non-compete agreements differ by state. I am in Texas.

Individual agencies may or may not require the new hire to sign a non-compete agreement. I have only run across this statement three or four times in more than twenty years of working for hh agencies. Generally said to be unenforceable, I would check with an employment attorney in your state to get accurate info for your situation. You say you are considering taking your clients to your new firm. You may, or may not run into legal problems, depending upon the atmosphere in your state. Again, I would check with an attorney. I have been told by several hh employers that stealing clients is definitely frowned upon, even if a common occurrence.
