I have a question........I endured a work injury and am having continued problems .......the case manager has requested that I fax her a list of aLL questions I will be asking the doctor prior to this office visit.This doc is a second opinion AFTER I have had a cervical fusion.I have an attorney and I am afraid they are more worried about playing cya than resolving my neck/shoulder injury problems.Have you guys ever had a doctor demand that you send them an all inclusive list of question prior to an office visit?

Did the doctor request the questions or the case manager? I have never heard of a physician requesting a list of questions beforehand. Sounds like it is coming from the case manager and personally I wouldn't submit them first to her for review. What does your attorney suugest that you do? Since you have one, I would definitely get their opinion.

I PMd you but would like to reiterate it does seem to be a strange request. I have sent my own set of questions to an independent exam or a second opinion that I was not attending but the compensability of your claim is obviously not an issue..seems like a strange request to me as well..not really sure what the purpose is? Erin

I know of NO clinician who would request this.
Secondly, I don't hold case managers in very high regard. This sounds like HER request. Those case managers who know me, know I'm usually not a nice person to them, because they come up with stupid stuff like this.
Finally, If the doc is requesting this. FIND ANOTHER ONE!
You're dead on b*lls accurate when you say (if this is comming from him) that he is more worried about a little CYA then HELPING YOU!
Course, if you wanna freak him out, your question list could go something like:
1. Will you write me some Oxycontin.
2. Will you write me some Oxycontin.
3. Will you write me some Oxycontin.
4. Will you write me some Oxycontin.
5. Will you write me some Oxycontin.
and for a change?
6. Will you write me some Oxycontin.

Okay Dave "be nice"...I am a case manager and I know of NO clinician or case manager that would request this either. About the Oxycontin..I have a claimant that is addicted..not abusing has just been on 20 mg QID for a long long time. He recently moved here from another state where it is still prescribed quite freely. There are literally NO Docs here that give it other than oncology ..all of the pain docs have left town apparently our state medical board ran them away? I finally found an AP for him and the plan is to start weaning him since he is getting close to going back to work after a long long rehab..the claimant wants off the med. In your exp how long does it take to wean someone? What is used in the interim..I know it is going to be difficult for him until his natural pain killers "kick back in"...any thoughts? I really hate to see this guy suffer anymore than nec..great guy and horrible injury!!..Thanks for any insight. Erin

What goes on between you and the doctor is HIPAA.
It's NOTB to the case manager. That's asking for info to CYA if i ever heard it.
HIPAA does not apply to L and I..if the ins employs a case manager the case manager is privy to all notes etc that relate to injury. Likewise, if an employer employs a case manager in most states (I think maybe all) the employer has the right to any medical record that relates to the on the job injury.
The questionare prior to the MD appt is silly though..Personally, I wouldn't do it..:) Erin
