I have not drank alcohol or eaten any alcohol byproducts. I tested positive for alcohol on 5/23 which is insane because I didn't do anything. The only thing is I picked up using a vape but actually threw it out a week later. I'm pretty sure it was the vape that made me test positive because nothing else has changed in my day to day. I checked the box and no ingredients mention anything related to ethanol. I got randomly selected: 5/29, 6/4, for urine and 6/9 for peth which were all negative—. I paid for a retest of the 5/23 specimen just in case it was a lab error bc I honestly didn't even consider the vape until I brought it up days later in group.
Has this happened to anyone? Why are vapes not mentioned in AA, rehab centers, or even contracts related to monitoring. It definitely isn't common knowledge that vapes can have a byproduct of alcohol. I vaped all Summer but didn't have an issue but I think it's this particular brand that created an issue.
my job is basically saying I have til 5/13 to get things figured out because my license was deactivated as per ramp due to the positive test and is unwilling to wait for the retest results. I am so frustrated.
do you think I have a legal case to go after the vape company if I become terminated/ "voluntarily resign?”
State BON acted to quickly IF.....IF.....they suspended your license that fast. If they issued a simple temporary "stop working order," without a suspension, they can unfortunately and legally do that, even Before the confirmation test is back, BUT if they did a temporary suspension based on the first initial drug test and didn't wait for the confirmation test, then I would get an attorney and seek a law suit. Notice I wrote what I personally would do. That's my opinion of me, if in this situation.
RAMP can not "Deactivate" your license. They can only report/request to the BON to do that.
I would be surprised if your license was suspended by the BON that fast. Sounds like your license with the BON is Not suspended and the issue is with the RAMP.
A monitoring program can also NOT tell you to stop working. They can recommend it and if you don't comply, they report that to the BON which then can tell you to stop working. The monitoring program does have the legal authority to report to, call, and email your employer and make them available of any test result, even a first time positive before the conformation is done proving it negative.
So, no offense and this sucks, but it sounds like you have to legal case just from one lay persons opinion. The BON did not Suspend your license so there is no issue there. The RAMP, unfortunately, can report any and all tests to your employer, so legally, you don't have much weight there. As for Morally Wrong and doing the wrong thing, RAMP certainly did that and apparently has no empathy over it, but legally, even if you lost your job based on the initial positive result, RAMP can report that to your employer. They should have waited until the confirmation test
RAMP NJ IS EXTREMELY UNETHICAL. Same thing happened to me n I was denied unemployment because my case manager told my employer that I was positive for drugs. They're cut off for everything is 0 so any and everything can spike a positive n unfortunately the witch who runs the program gets a thrill over ruining ppls lives as well as the case managers. Im sorry this happened to u but unfortunately it has happened to many ppl in RAMP. Participants have even committed suicide in this monitoring program. It's horrible

Yes, I had to opt in for the retest and pay an additional 85$. it took longer for those results to come than the peth test I took which is insane because the urine is still at the facility. There was no transporting new urine.... I do not understand why it cost so much and why it took so long since all they had to do is find it and rerun it the specimen.
I test through affinity and I believe it was sent Quest Labs. I will be requesting a refund
