Need Legal Help To A Situation: Lvn Refused Her Task

Published

I worked in skilled nursing facitlity for 4 years; nurse for 8 years. I worked 16 hours on a Saturday and went back to work Sun at 0700. The LVN who preceeded me refused to do her cs, insulins, vs, medicare charging, etc.. for what she perceived as justified. When I went to work, I ended up writing her up and 2 LVN's who were clocked in did the cs/insulins for me as I was busy right off the bat that am.

I wrote the LVN up, she was fired and I was fired because I personally did not do the cs/insulins. What recourse do I have for this LVN not doing her duties. Should I turn this into the BNE?

My goodness, no sense in getting so defensive and YELLING, you can't get good advice or help without giving good information. All everybody is trying to say is, there must be more to this than what we know. There is always two sides to a story. You said the previous LVN felt justified. What was her justification? You also stated that you had called state before, obviously, there is something going on there that we don't know about. If you have moved on and are happy where you are, I say, don't look back. There is a reason for everything. Sounds to me like you are PO'd and out for revenge.

I Think You Are The One Getting The Wrong Message. If You Look, You Will See I Posted This Back In 2004. I Am Not Out For Revenge. I Am Perfectly Happy With Myself. I Don't Need Revenge In My Life. You Don't Even Know Me. You Need To Look At Yourself Before You Start Judging People So Harshly.

In my experience it is part of the job description to do your required duties. What was the person you wrote ups justification for not doing the bloodsugars?

I agree with you whole heartedly, "You need to look at yourself before you start judging people so harshly". I'm not judging anybody, not my job. After reading some of your previous posts though, I will not apologize for my opinion, but I will apologize for allowing myself to get sucked into this conversation. Have a wonderful day.
