hi! this is a great site btw! i just have some questions in mind, i hope someone can tell me which way to go hehe:lol2: i graduated from the phil last year, did my nle and ielts there and passed, then i came here in the us and took the nclex exam and passed, i have my visa screen certificate on process and right now i am running out of time. I dont know the best option i should take, my stay here is about to expire and i need to have a visa to work here. The april opening for fy 2009 is fast approaching and i dont know if i should go with the h1c or the h1b visa? or is it not a good option to shoot blindly at these visas and waste money? i am desperate and in dire need of help hehe thanks!

There is no way at the moment for you to stay in the US and be able to work. There are no visas as retrogression has been in progress since 2006 and currently unable to adjust your status. H1B you will not meet criteria for and generally employers do not use this route anymore and haven't done for a few years, there are some exceptions but you need to be highly experienced in an area and meet strict guidelines. Also with H1B it is filed in April and demand is high with no guarantee on getting one and can not work until Oct with no way to stay in status until then. H1C there are only a few hospitals that can apply for this and with no idea what will happen after 2010 when it is up for renewal so no guarantee you can stay in the US and if you loose your job then have only x amount of days to find another hospital with H1C status to take over.

Many have waited patiently in their own countries or moved to other countries to gain experience and this feels as if you have tried to jump the queue as you must have heard something about retrogression before you moved to the US last year

I agree 100% with what Anna has posted. There are no visas available for you at this time, and I am sure that you were aware of this when you came to the US months ago. Your visa was issued for 6 months maximum and that is what you will have to abide by.

The H1-C visa, which is set to expire in 2010 takes about 4 months to process and that cannot even be started until you actually have a VSC in hand and have an employer that will sponsor you. There are only 15 facilities out of the entire US that can do that.

H1-B visas have not been avaiable for the bedside nurse in more than three years.

There just is no option available for you to remain legally in the US and be able to work. Overstaying of a visa can get you deported and you do not have a SSN#, so many states will not have issued a license to you.

Please take the time to do some reading here as the retrogression has been in place since October, 2006 and you must have had some idea that there were no visas available for you, or anyone else.

Have safe trip home and then do things the legal way from there, that is your only option. And please be aware that there is no guarantee that you will be able to get a green card, there is no guarantee for anyone anymore. Many more applicants from your country than there are visas available.
