NCLEX, Receicing license and previous arrest

Nurses Criminal

Published

I am a current nursing student halfway through my program and I am concerned about an arrest that happened almost 5 years ago that will hinder me from being able to take the NCLEX-RN and get my license.

A short background on what happened. My boyfriend at the time and a bouncer got into a fight outside of a bar. I stupidly tried to intervene to get them to stop fighting and I grab the hair of the bouncer and slapped him in the face. I ended up being arrested for assault-intent/reckless/injury which is a misdemeanor and hindering prosecution 1st degree which is a felony (the police thought I was holding back information about the situation but I was completely upfront with everything) I was never charged with anything, never went to court or anything like that. I totally understand that I was in the wrong and should've never interfered with the situation, and now I'm very worried about being able to take the boards.

I had no issue getting into nursing school or even going to clinicals. My program required us to submit fingerprints along with our background check. I know that getting into school/going to clinicals with a criminal record background is much different than getting your license. I even got a criminal history check on myself before I applied for school to make sure everything was correct with my arrest. I know I was not charged with anything because under both of my arrest it says "not referred for prosecution".

I have been reading about other peoples situations that are similar to mine and it seems that if you are upfront before you go to take the NCLEX and provide all the information they need you have a better outcome.

I will be taking my boards in North Carolina but I really don't know where to start. It stays on the NCBON:

Prior Criminal Convictions:

If you have prior criminal convictions (misdemeanors and/or felonies) regardless of the age of conviction, you must submit the following to the Board of Nursing:

  • Original certified court documents for all convictions (misdemeanors or felonies); and
  • A detailed explanation of the events leading to the arrest and any other pertinent details if the conviction occurred within the last 5 years.

I can see from reading this above they are concerned about convictions, not arrests. But I would rather be upfront about my arrest then look like I'm trying to hide it, but I really don't know what the best way to go about this is. Has anybody else had experience with a similar situation? I don't know if I need to hire an attorney to help me with this issue, and if I do, I don't know the type of attorney to look for.

Thank you so much for any information.

If you truly just got arrested with no conviction...the only question needing to be answered is concerning convictions and the answer is "No". Do not volunteer any other info.
