Monitoring

Published

Hi everyone. Just wondering if all board orders include monitoring . Like a lot of you know already, I self reported to the BON in Feb 2016, met with an investigator, gave my story , even filled out papers to get into the monitoring program. I haven’t heard anything from them . The first year (2016) I called the board and my investigator several times and all I got was “they are working on it”. I’ve done my part but it’s just weird. I’ve renewed my license twice since then and my license is active with no discipline!! I was thinking maybe they were waiting on the attorney generals office because I just received a call from the AGs office 2 weeks ago for me to call them back - well I didn’t - I had my lawyer call them and never could get anyone on the phone.

Has anyone had anything similar??? The time frame is just so long that I’m thinking why would they try to do something now after I’m 3 years sober and working with no problems. My lawyer is thinking the AGs office has gone past their statue of limitations just depending on when I was reported to them. But I’ve heard the nursing board doesn’t have a statue of limitations. The lawyer I have is one I hired in 2016 when I had to deal with the DEA- the DEA never arrested me - my lawyer sad they didn’t have enough evidence.

I’m just thinking what the heck now after 3 years!! And yes I would definitely pass a drug test!

They took three years to get to my case. I was advised to go "inactive" and did so. I think the length of time was due to that. I "looked" good by going inactive. Most can't afford this and honestly the less strict agreement I got wasn't worth the hell of those three years. I couldn't work as a nurse obviously.

It seems they can do whatever the h#%@ they want to do. Have your ducks in a row and stay lawyered up. My consent agreement was just basically made up and sent to me one day. I was shocked and terrified. Its not a big deal anymore that an inconvenience and expense at this point.

My new tirade is that I have no privacy. Ohio's "alternative program" is never used according to my lawyer. She said she hasn't seen a client get into it for years. No privacy for us...

Same issue here in MA. Took them 5 years to even have a hearing, without contacting me. I have done a ton of research and yes, there is a time limit. I won’t go through my whole situation here as I already posted it and you’re welcome to read it but I would fight it. Check out Miles vs West Virginia BORPN...there’s PLENTY of case law to require them to get their act together in a timely manner....the more of us who fight for reasonable accommodation, the less they’ll think they can do whatever they want....period....

Thanks, how did your case turn out?

My home State is NH, I am licensed in MA by reciprocity. I was unaware of the MA revocation until I went to renew my NH license....then the whole ****storm started again...I went before the NH board and it was dismissed without ANY discipline or any marks....MA still stands “revoked/expired....I asked NH why they hadn’t dismissed it in MA and they were just as confused as I was. I’ll be writing to the MABORN to request reinstatement without discipline. If they decline, I’ll be lawyering up, and will guarantee that it won’t end in their favor....I’m sick to death of this **** that they put nurses through.....it’s all a *** money scheme and it’s about time we stood up for ourselves......they’ve got it down to a science....even an NPDB report on YOURSELF costs money!!! I call ***....?

I’m pretty sure they’ll be hard pressed to explain why it took five years to impose discipline on an impaired nurse....it’s a good thing that I’m just a nurse who has ADD and a script for my medication......it’s a really good thing....because in that amount of time, if I were impaired, as they claim, there could have been an enormous amount of damage done, as I have and continue to practice nursing.....rant over....

.... I’ll also be sending a copy of my request for reinstatement to AG Maura Healy......she’ll be interested, I’m sure......there are only a few things that I don’t allow people to mess with....my kids, my livelihood and my reputation....the gloves are off at this point....

Hey guys wanted to ask a quick question about HPMP. When we fill out our own reports of our NA/AA/Caduceus meetings we are required to attend is that report verified by our HPMP case manager. Am I going to get into trouble for making up some of the topics discussed at the meetings since I didn’t write them down initially and have no clue what was discussed?
