i live in california and have a medical marijuana card. i'm signed up to start my prereqs but thought i would ask here first.
i DO NOT smoke. i have the card for other reasons. is this going to hurt me? doesn't the background just cover arrests?
thanks!
First of all, many on this forum need realize that many medical marijuana users don't SMOKE it at all. Everyone knows that smoking is not good for lung health. This is the reason why many medical marijuana users extract the active ingredients into butter and use that in food or to cook/bake with, in effect getting their medicine which was recommended by their prescriber. Some medical marijuana users go another route and use a vaporizer where they are not smoking either, but inhaling water vapors. It is scientific fact that marijuana is extremely non-toxic, by the way.
OK you try that one on when the DEA's rounding people up. You can share a cell with the tax protesters.[/quote']Not really if you take it to federal court. Here is a link of a person with the same situation and the supreme court ruled in favor of the person prescribed marijuana. This is one proof that it is a myth that "federal law trumps state law". The Supreme court recognizes this as not constitutional. Here is a link explaining it all if you care to read about it http://www.letfreedomgrow.com/articles/ca081212.htm . Here is what the court said:
"Here is how the three Appeals Court judges put it:
"Congress enacted the CSA to combat recreational drug abuse and curb drug trafficking. Gonzales v. Oregon, supra, 546 U.S. at p. 271; Gonzales v. Raich, supra, 545 U.S. at pp. 10-13.) Its goal was not to regulate the practice of medicine, a task that falls within the traditional powers of the states. (Gonzales v. Oregon, supra, 546 U.S. at p. 269.) Speaking for the majority in Gonzales v. Oregon, Justice Kennedy explained, "The [CSA] and our case law amply support the conclusion that Congress regulates medical practice insofar as it bars doctors from using their prescription-writing powers as a means to engage in illicit drug dealing and trafficking as conventionally understood. Beyond this, however, the statute manifests no intent to regulate the practice of medicine generally." (Ibid.)"
Wondered about this for a LONG time. Seems to me.....ya pass the pee test......ya have good judgement.....you are not high at work....(who could do the jpb efficiently if they were high anyway).......it is no one's biz but yours. There was a time I had to use benzos to sleep and through some life changes....(prescribed).....I was honest.....it wasn't in the tox screen......I showed my script and almost full bottle.....and no one cared.....got the job......still there.... But MJ is so different. I can't wait for the various BONS decisions.....and also can't wait for insomnia to be one of the criteria for the card. It really has no side effects when used as a sleep aid. ( Experience found before being an RN).......Man......I had a manager whos eyes were pinpoint all the time. And she had the nerve to ban another RN from the bedside until she was off her cancer narcs...hmmmm...this career is very strange at times.
I once asked an ER doc if he had ever had someone come in from an accident with JUST MJ in their system... He said NO... people can smoke cigarettes and they do absolutlely nothing but shorten your life... INSOMNIA is one of the widest spread health problems in the nation...everyone else is on ambien or sonata... yes MJ helps people sleep, I have seen it work...Would anyone like to compare statistics with ETOH related problems? people LEGALLY drink themselves to sleep...I have had more patients in my life with problems r/t ETOH than anything else combined...and im in CA...fyi
I am on medications and was told by the BRN as long as I had PRESCRIPTIONS for anything that turns up in a test, it's ok...so being honest has it's merits...then again a few wks after I told my boss I was on low dose mscontin, they started digging thru my work with a fine tooth comb... so use your judgement i guess... only problem is those drugs are out of your system a lot faster than MJ...yes it is a weird thing happening...
