I have a question. I was injured at work. A groin strain. So the workman comp Dr put me on seated work only. Well my employer provided a wheelchair and a CNA to push me around. I work nights in a nursing home. Well doing it that way killed my back and also caused a bruise on my right arm, because it got caught between the wheelchair and the foot of a bed. Well I told my boss that killed my back. So their solution was to have the CNA pull my meds for me. And we do not have med techs in this nursing home. Has anyone ever been asked to to do something like this? I wouldn't do it and in the morning, I asked the DON to put it into writing, which he wouldn't do. When I went back to the Dr he wrote no med pass and no direct or care. So now they are changing my days like a 1 1/2 hours saying we are cancelling you today so tomorrow you will work 3-11. I told them when I got to work today, because I missed the message, I can't work tomorrow because I made plans with my family since I have to work Sat since it is my holiday. I need to get out of this place. Oh and they said you will be off Sat, so no holiday pay.

I'm confused. Are you still off work or are you back to work without restrictions from your injury?

If you are unable to do your job and your employer is unable to accommodate you to find something you can do, it's my understanding you are off work, but should be getting paid (regular time for hours scheduled).

I'm no worker's comp expert, so you should look up the worker's comp rules to see where you stand (or sit) 😉. I'm sorry to hear about your injury. Take care of yourself.

As far as letting someone who is not qualified pull my meds and me be held accountable? Absolutely not.

I am working with restrictions> But they change my schedule with very little notice, to help themselves out. I was supposed to work yesterday, went to work and they said we have been calling you to cancel you. The only message left was call back. I figured they wanted to know what the DR said since I had seen him the day before at 3:30pm. Never left a message that I was cancelled until 1:18 when I was already on my way since I work 3-11. They said you are cancelled today but working tomorrow. I said I can't. I made plans with my family since 7-4 is my holiday to work and they said no you will be off Saturday.

Why aren't you off on an FMLA??? One, no one should be being wheeled around in a wheelchair to do their duties...what if there is an emergency? I'd be cailing workman comp and reporting this as an unsafe practice. And I's call risk management too!

As as for the mess, no way. Is there an HR department you can go to since it sounds like the DON is an ass.

Wow, no no no! Have you told your doc what kind of "modified" duty they have you doing? I'm sure when he said "seated", he meant sedentary duties such as filing, answering phones, desk work.

With an employer pulling that kind of crap, inform the doc; he may just take you off duty completely until you can be released without restrictions. You might consider consulting a WC atty.
