Hello Lorie
What kind of rights does someone have when their nursing license is being held by the board until they complete an "evaluation" with a monitoring program when an individual truly does not have a substance abuse or mental health issue? Is there anything that can be done to fight the decision of the program/evaluation if it is unfair/unjust? In addition, what can be done in the event of a false positive Ets/Etg test due to the extremely low cutoff levels?
Hello License Under Evaluation
The Nursing Board can make whatever decisions that they deem necessary to protect the public and if one of them is for you to obtain an evaluation with a monitoring program, you will need to get that eval. If you do not follow their order, they can take further action.
You should contact the provider of the testing or the Medical Review Officer to determine what other tests can be done to show that the level is not positive.
