does L2 visa holders needs visa screen?

Published

hi! my husband will be provided by his company with an L1 visa. and i can get an L2 visa ryt? i know that L2 visa holders can actually work in the US, but do they still need to have a visa screen certificate? what are the EAD requirements? Please enlighten me thanks!

This is something that you are going to need to check with his company about. Not all L1 visa holders get working visas for their spouses any longer. This is also discussed in the US State Dept Bulletins.

Not all L2 visa holders can work in the US any longer, this started last year. If one gets the L2 and has work priv. with it, then they do not need the VSC as they will already have a visa. But that is where you may have issues.

It is not a specific EAD requirement that you need to worry about, but the fact if you can truly work with it. The last people that I have seen come over with that, have not been able to work. You need to check that out thoroughly first with his company and/or the immigration attorney that is handling your files.

Thread also moved to the International Forum where it is more appropriate.

My husband actually told me that their company allows L2 visa holders to work in the US upon request since its an American company... If ever I could actually work there as a L2, would i still need a visa screen if I decide to apply for H1 visa or if we want to convert my visa?

I would get it in writing that you have EAD which will enable you to work. Even if a US company there is no guarantee you will be allowed to work. If converting your L2 to another visa you will need VSC

First question: If you would be on the L2 that will permit you to work, and not all of them permit it. Depends first of all if the US government will issue the EAD to you and that is the document that is required for you to work here. Why would you want to try for the H1-B? That makes no sense at all to me.

If you decide for whatever reason to go for the H1-B that can get cancelled at anytime, etc; you need to have the VSC in hand since you would be the one applying for the visa, not as a spousal dependent. And that visa also requires that you possess a license for the state where you wish to work as well as the VSC before you can even be submitted for that.

With the L2, you only need to pass the NCLEX exam and have the EAD.

so it really depends upon the company that will apply for my L2 visa... what are the EAD requirements?

It is not a point of what the requirements are for the EAD, but if the company that is sponsoring your husband is able to provide the L-2 that will permit you to work here.

The L-2 visa is no longer routinely permitting the spouse to work, this started over a year ago.

You will need to check with your husband's employer directly about this. If no mention was made to you about working with it by them, then chances are that you are not going to be able to. So contact them first before you start to try to make any plans.

If you in fact get the L-2 that will permit you to work, you will not need the VSC as you are not going to be applying for a visa on your own, but getting one for being a spouse. So therefore, you do not need it.

if i don't get the permit to work there with my L2 visa, what other options do i have to be able to practice my profession?
