If on H4 then you are going to find it hard to adjust your status and work. Going with an agency or recruiter will not make it any easier due to retrogression and coming from India you have a long wait

There are no visas for you to adjust your status to at this time. Even if you find a facility to offer you a job, the US does not have any visas available. And the issuance of a visa is also based on country of birth; your country already has many applicants for a limited number of visas so the wait will be even longer for you. Currently, you are looking at five years plus, and suspect that your spouse's H1-B will be up befor then.

Best of luck to you. But this is just not a good time in terms of immigration here in the US.

Have you actually taken the series of English exams? You are also going to need a Visa Screen Certificate in hand to qualify for any visa.

Thank you for your reply. I have already given the English exam and visa screen certificate will be in my hand in few days. I am living in chicago. I heard that the green card is opening in october this year. Is this true?

The bulletin is expected to reopen in October but will not be current so can not Adjust your status. It is expected to have a PD of early 2006but a lot depends on place of birth and definitely will not be able to get GC.

Green card issuance is expected to open up again with the beginning of the new fiscal year, but that requires that one has a complete petition/file with the US State Dept and has approval on all of the sections that are required.

The other issue is that visas are also issued by country of birth, and India has many more applicants for the EB-3 visa, which is the green card, that the numbers for India have been regressed much earlier than the others in terms of PD date, or priority date. Do not expect things to open up for quite some time for you at the earliest.

You may find a facility willing to start the process for you and get the I-140 submitted,; but then you are up against a brick wall and nothing will be moving forward for sometime.

Even if the bill goes thru for the additional 20,000 green cards per year, that still will not help you as there are many in front of you in-line that will take up the three years worth. Unfortunately, things are not looking good for obtaining any type of visa to work here in the near future.

Best of luck to you.

Thank u for ur kind information. I have one friend in the same status. She is from Nepal . It means her process can take less time than mine if GC opens. Isn't it?

No one really knows what will happen but prediction for Philippine and other countries except India and China was PD of early 2006. So if your friend hasn't started the process yet then they are expecting a long wait

Depends on when she started the process for immigration and what her PD date. You do not have a PD date as of yet, so you are looking at probably five years plus.

Even before things closed down for this fiscal year, the wait for those from India was about two years behind the others.

H1-B visas are only for three years and can be renewed just once for a total of about six years; then the person is required to leave the US. Not sure how long that your husband has been here working already.
