Hey guys, we have a new case (I work at a med mal firm) where an MA was fired for texting a patient to ask if he was dating anyone. The employer felt that this was a HIPAA violation so she was fired. Do you guys think this actually counts as a violation?

If the MA got the pt's phone # from the chart, that does sound like a HIPAA vio

No deeper meaning behind how I worded it! That's just how I say things when I'm trying to make sure that I have it correct. :)

How number was obtained and if they were in a position of power over patient or if patient had compact or was ill at the time.
