Is it illegal to double brief a nursing home resident?

While there isn't a specific law that outright declares double-briefing illegal, it is not good practice. It is undignified and could be uncomfortable, unsafe, increase the risk of skin issues, and interfere with proper hygiene.

Nursing homes are highly regulated in order to receive reimbursement, and residents have rights to protect their safety and dignity. A facility that allows this could be cited by their overseeing state department if a complaint was made to the state department or ombudsman.

  • If double-briefing is being done for convenience rather than proper care, it may be considered neglect.
  • If it's done improperly and harms a resident , it could fall under the category of neglect or abuse.

Regulations vary by state and facility, but key issues are whether the practice is appropriate and individualized for the resident's health needs, whether it is done with dignity in mind, and whether it potentially causes harm.
