If I marry my fiancee after filing of the I140, will he still be included in my petition? Will he still be able to qualify for the following to join benefits? Or will he go through the family based petition 2a preference?

Even if the baby is born after you get Packet 3, they can be added to your petition at the US Embassy, but that is the only exception. You cannot add an infant until they are born, and many have kids before they come to the US while they are in the processing stage. The baby will be able to come, just make sure that you bring all of their documentation with you when you go to the US Embassy.

You can add your new born child in a new DS230 even at the time of your consular interview.If you are still pregnant at the time of the interview, there is no way that the embassy will not allow you to bring your unborn baby with you.:chuckle :chuckle

If the baby is unborn, then they do not need to be added to the DS-230 at the time of the interview.

The only exception that can make for a change to the filed DS-230 is the birth of a baby. Anything else, and they are required to wait.
