Initially denied in CA, apply to other states?

Published

I was recently denied by the CA BRN due to two misdemeanors. I don't want to appeal because I feel ill just get a restricted license.

Has this happened to anyone and then decided to apply to other states? I'm thinking of applying to Washington. I know my denial will be considered but I also plan on turning everything I turned into CA BRN: 13 LORS, proof of scholarships, proof of Volunteer work, explanation letter, court docs, and evaluations stating I am not an alcoholic (denial due to DUI).

Has anyone had any luck? Any help will be greatly appreciated. I thought I had a strong case but apparently I didn't ( for CA). Please no negative comments.

California is known to be super strict with DUIs. I think you will have a better chance in other states especially with all your supporting documents. You will have to put that you have been denied a license before.

Are both of your misdemeanors DUI?

No, the other one is a "disturbing the peace". I am going to start the process of dismissing this charge next week. I'm just curious to hear of others who left CA after denial and continued to succeed in their endeavors. We are all successful and smart. We are not our mistakes. Just like patients are not Alzheimer's or patients are not Cancer. (extreme examples but same principle) I do understand that I will have to tell the other States I've been denied in CA. I've been in contact with Washington. I haven't officially applied but they seem a lot nicer and more human than the CA BRN.

Is this your first time trying to get a license or are you trying for reciprocity from another state? Based on the charges you refer to, did your license have restrictions there or is the BRN just now notifying you as a new grad that you are not eligible to take the NCLEX?

If you can afford it and think there might ever be a time in your life (get out the crystal ball) that you might need/want to work in CA, consider hiring a lawyer who specializes in working with the BRN. It could be worth it to have them work with the BRN to allow you to test or get the final penalty potentially reduced to license with "public reprimand" if you can submit proof of completing all court required requirements, counseling, etc.

California is strict, no doubt about it. Now that you have been denied and might not be considering an appeal process this information could translate to other states with subsequent negative results. I am not a lawyer but I urge you to consult with one.

Specializes in Complex pedi to LTC/SA & now a manager.

You will have to report your application was denied when applying to other states it's now a standard application question.

The BRN is just now notifying me that I am not eligible to take the NCLEX due to unprofessional behavior. It just so happens that the Public Defender helping me dismiss one of my charges also helps people obtain occupational licenses! She is also going to get me in contact with a group of other lawyers (different county) to dismiss my DUI,or try to at least. They are over three years old and all court requirements, fees, etc have been completed a long time ago. My worry is do I chance it and try the CA BRN with a possibility of a restricted license, which I do not want. Or should I try another state (Washington)? I've contacted Washington and they will look at everything (charges, paperwork, denial in CA) So I am in a major pickle with a deadline (Jan 20). I was curious to hear from folks who have been denied in CA and have been successful elsewhere?? Pretty bummed here guys. I work at a teaching hospital, sent many letters, scholarships, volunteer work, court docs, everything. Still denied. Don't know what to do? I mentioned I do have a Lawyer/ Public Defender but I would like to hear from anyone who went to another state after denial? Or any other advice/ words of wisdom? Or words of encouragement.
