Hello Lorie
I was arrested for a DUI on New Years Day. I was not guilty and am having my case tried with a jury. If I attempt to obtain a compact license, would the arrest appear during a background check, and if yes, could this be held against me re: my current license?
Each state has its own questions regarding criminal matters. Some ask if you have ever been arrested while others do not. If your state specifically asks if you've ever been arrested, you will need to disclose that. Just read the question carefully and seek the assistance of an attorney if you are unsure.
Saying "I misunderstood the question" is not a defense. Each case is unique and the Board will take these types of matters on a case-by-case basis.
If you are found not guilty, see if you can have the arrest expunged. Depending on what state you live in, you may not have to answer that question. Just having your case dismissed is not enough. You need to specifically get the arrest expunged.
